HomeMy WebLinkAboutReso 3743-1963RESOLUTION NO.3743 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO VACATING STREET EASE- MENT OVER A PORTION OF CALIFORNIA AVENUE EAST OF BAYSHORE FREEWAY WHEREAS, a public easement or right of way was acquired over the area hereinafter described and commonly known as a portion of California Avenue located East of Bayshore Free- way, and, WHEREAS, said public easement or right of way has not been used as a public easement or right of way for five con- secutive years next preceeding the date of this vacation pro- ceeding; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco finds and determines that: 1. Except for the lO-foot storm sewer easement located within the boundaries of the public easement or right of way, City has not used the public easement or right of way more particularly hereinafter described for a period of five years next preceeding the date of this vacation proceeding. 2. City has continuously used the 10-foot storm sewer easement located within the boundaries of the public easement or right of way. BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco, except for the reservation hereinafter made, does vacate and abandon the public easement for roadway purposes over the following described parcel of land: All that certain real property situate in the City of South San Francisco, County of San Mateo, State of described as follows: Beginning at the northeasterly corner of California Avenue and Division Street (now known as Dubuque Avenue) said Street and Avenue appear on the map entitled "South San Francisco, San Mated Co., Cai. Plat No.l", which map was filed in the office of.the Recorder of the County of San MateD, State of California, on Hatch 1, 1892, in Book "B" of Maps at page 6 and a copy entered in Book 2 of Maps at page 52, said point of beginning also being the most westerly corner of that certain 10.44 acre tract of land conveyed by South San Francisco Land and Improvement Company to Enterprise FoUndry Company by Deed recorded July 15, 1918 in Book 269 of Deeds at page 462, records of said San MateD County, and running thence along the southwesterly line of said 10.44 acre tract of land S 74° 27' E 58.26 feet; thence S 67° 45' 10" E 339.80 feet to a 3/4" iron pipe monument set in the northwesterly line of that certain 1OO foot strip of land containing 8.04 acres of land and conveyed by South San FranciscoLand and Improve- ment Company to Southern Pacific Company. by Deed recorded March 21, 1895 in Book 68 of Deeds at page 426; thence along th& northwesterly line of said 8.04 acre tract of land S 37° 32' 40" W 62.20 feet to a 3/4" iron pipe monument; ,thence along the northeasterly line of that certain 5.15 acre tract of land secondly described in the Deed from South San FranciSco Land and Improvement Company to Southern Pacific Railroad Company recorded March 21, 1895 in Book 68 of Deeds at page 426 and along the' southwesterly line of that certain 7.67 acre tract of land secondly described in the Deed ee South San Francisco Land and Improvement Company from Southern Pacific Railroad Company recorded April 29, 1901 in Book 89 of Deeds at page 99 0 I ,, It N 67 45 10 W 319.88 feet to a 3/4 iron pipe monument; thence., N 74° 27' W 61.79 feet to a 3/4" iron pipe montuaent set in the southeasterly line of Division Street (now known as Dubu~e Avenue) as shown upon said map entitled "South San Francisco, San Mated Co., Cal. Plat No.l'; thence along said southeasterly line of Division S~reet (now known as Dubuque Avenue) N 22° 14' 50" E 60.41 feet to the point of beginning and 0.537 acres' of land more or less. and does expressly reserve a 10-foot wide storm sewer ease- ment lying equally five feet on each side of the following described centerline: Beginning at a point on the Easterly line of Division Street (now known as Dubuque Avenue) South 22° 14' 50" West 51.20 feet from the point of inter- section of said Easterly line of Division Street with the Northerly line of California Avenue pro- duced Easterly, running thence South 75° 48' 54" East 402.7 feet more or less to a point on the Wester- ly line of the right of way of the Southern Pacific Railroad Company, said point being distant South 37° 32' 40" West 1.8 feet from the Southeasterly corner of that certain 10.44 acre tract of land conveyed by South San Francisco Land and Improvement Company to Enterprise Foundry Company by Deed recorded July 15, 191§ in Book 269 of Deeds at page 462, records of said San Marco County.
