HomeMy WebLinkAboutReso 3796-1963RESOLUTION NO. 3796 RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO TO ANNEX TO SAID CITY CERTAIN UN- INHABITED TERRITORY DESCRIBED HEREIN AND DESIG- NATED "DEVINCENZI TERRITORY" AND GIVING NOTICE OF THE PROPOSED ANNEXATION BEFIT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of South San Francisco, on its own motion, to annex to the City of South San Francis- co all that uninhabited territory situate in the County of San Mateo, State of California, hereby designated as "Devin- cenzi Territory" and described as follows: (Mission Cardens :he City of South San Francisco beginning being that point wher~ the Land of Devincenzi and that ,/he Spring Valley Lands, intersects the Soul Mission Road (originally the main Cou'.~ty' Road San Francisco to San Jose), said division Eence line being the property line as described in that Devincenzi Deed recorded in Book 195 of Deeds at page 244 on January 25, 1911 in the Official ~ecords of San ~ateo County{ thence on and along the ~xisttng corporate limit City of South San Francisco and along the said line l~ ~d North 40° 54' West 277.20 feet; thence North 49° feet to the Westerly line of said Devincenzi proper- g said city corporate limit line of the City of Francisco and the Southeesterly line of~Ksston Road 36' West 146.52 feet to a point in the Northeasterly right of way line of the Southern Pacific Company; thence South- easterly on and along said Southern Pacific Company right of way line 337.26 feet to a point of intersection of the division fence line mentioned above; thence on and along said division fence line North 42° 36' East 106.26 feet; returning to the existing cot- beginning. porate lfln~t of the City of South San Francisco and 'th~ )oint of Said area contains approximately one acr~~ ~'~"~,-~ . 2. That the Council of the City of South San Fran- cisco desires to annex said uninhabited territory to the City of South San Francisco for the following reasons: The territory is contiguous to the City of South San Francisco and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and con- tribute to the proper and orderly layout, design and con- struction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands, and subdivision of lands in said City and said unin- habited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of San Marco County, California, did in session duly assembled on the 16th day of March, 1961, approve the proposed annexation boundaries of said "Devincenzi Territory" as above described and as sub- mitted to said Commission by the City of South San Francisco. 4. That Monday, December 2 , 19 63 , at the hour of 8 o'clock p.m., in the Council Chambers in the City Hall of the City of South San Francisco, County of San Mateo, California, is hereby fixed as the time and place when and where any person owning real property within the un- inhabited territory above described and proposed to be an- nexed to the City of South San Francisco, and having objections to the proposed annexation, may appear before the Council of the City of South San Francisco and show cause why such un- inhabited territory should not be so annexed'to said City of South San Francisco. Such protest must be in writing, may be filed at any time before the hour set for hearing objections me to the proposed annexation, and shall state the name or names of the owner or owners of the property affected, and the description and the area of such property, in general terms. 5. The City Clerk of the City of South San Francisco is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Enterprise-Journal, a newspaper of general circulation published in said City of South San Fran- cisco, the city to which it is proposed to annex the afore- said territory, and also in the Advance-Star, a newspaper of general circulation published outside the City of South San Francisco, but in the County of San Mateo, California, the county in which is located the territory proposed to be an- nexed to the City of South San Francisco, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land withinthe territory pro- posed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceed- ings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be ~' 1]11 T Z [' T mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
