HomeMy WebLinkAboutRDA Reso 10-2008RESOLUTION NO. 10-2008 REDEVELOPMENT AGENCY OF THE CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING THE DOWNTOWN IMPROVEMENT PF:OGRAM AND AUTHORIZING FUNDING FOR PHASE 1 FOR $75,000 FROM THE 2007-2008 REDEVELOPMENT' AGENCY OPERATING BUDGET WHEREAS, on July 12, 1.989, the City Council adopted Ordinance No. 1056-89, approving the Downtown/Central Redevelopment Plan including the South San Francisco Downtown Project Area ("Project Area"); and WHEREAS, on September 7, 2007, the City Council conducted a study session considering long-term development strategies and urban design ideas for the Project Area; and WHEREAS, pursuant to California Community Redevelopment Law (Health and Safety Code Section 33000 et. seq.) (the "Redevelopment Law"), the Redevelopment Agency ("Agency") is authorized to engage in redevelopment activities that alleviate blighting conditions within the Project Area and that primarily benefit the Project Area, within the territorial jurisdiction of the Agency; and WHEREAS, pursuant to Redevelopment Law Section 33445, a redevelopment agency may, with the consent of the legislative body, pay for the cost of the construction of improvements that are publicly owned if the legislative body determines all of the following: 1. That the improvements are of benefit to the project area or the immediate neighborhood in which the project is located; 2. That no other reasonable means of financing the improvements is available to the community; and 3. That the payment of funds for the cost of improvements will assist in the elimination of one or more blighting conditions inside the project area, and will be consistent with the implementation plan adopted by the redevelopment agency; and WHEREAS, the costs of the Project were approved in the Agency's current FY budget; and WHEREAS, the City Council finds that: (i) the Project will be a benefit to the Project area, (ii) no other reasonable means of financing the Project is available to the City, and (iii) the expenditure accomplishes the goal of eliminating one or more blighting conditions inside the Project Area; NOW, THEREFORE, BE IT' RESOLVED by the Redevelopment Agency of the City of South San Francisco as follows: Section 1. The Agency hereby finds that all recitals are true and correct, and approves in concept the Downtown Improvement Program. Section 2. The Agency hereby finds that (i) the expenditure of tax increment funds to undertake the Project as set forth in this Resolution and the implementation plan heretofore adopted by the Agency for the Project Area (the "Implementation Plan") will be of benefit to the Project Area, (ii) no other reasonable means of financing the Project is reasonably available, (iii) completion of the Project will elvninate blighting conditions in the Project Area; and (iv) completion of the Project is consistent with the Implementation Plan. Section 3. The expenditure of tax increment funds in an amount not to exceed $75,000 for the Project is hereby approved and the Executive Director of the Agency, or his designee, is hereby directed to execute any documents necessary to implement Phase 1 of the Program. Section 4. The Executive Director of the Agency or her designee is hereby authorized to execute and deliver such other instruments and to take such other action as necessary to carry out the intent of this Resolution. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the Redevelopment Agency of t:he City of South San Francisco at a regular meeting held on the 14th day of May 2008 by the following vote: AYES: Boardmembers Mark N Addiego Richard A.
