HomeMy WebLinkAboutReso 135-1999RESOLUTION 135-99 CITY COUNCIL CITY OF SOUTH SAN FRANCISCO A RESOLUTION CERTIFYING THE SOUTH SAN FRANCISCO GENERAL PLAN ENVIRONMENTAL IMPACT REPORT EIR-99-61, ADOPTING FINDINGS REGARDING SIGNIFICANT AND POTENTIALLY SIGNIFICANT IMPACTS, ADOPTING A STATEMENT OF OVERRIDING CONSIDERATIONS, AND ADOPTING A MITIGATION MONITORING PROGRAM FOR THE SOUTH SAN FRANCISCO GENERAL PLAN AFFECTING THE CITY OF SOUTH SAN FRANCISCO PLANNING AREA. WHEREAS, an Environmental Impact Report has been prepared in accordance with the provisions of the California Environmental Quality Act (CEQA); and WHEREAS, a Notice of Preparation was prepared in December 1997, published in a newspaper of general circulation, and mailed to responsible agencies, public agencies having jurisdiction by law over natural resources affected by the project, and other interested parties; and WHEREAS, a Draft Environmental Impact Report, dated June 1999, was prepared for the General Plan. A Notice of Completion was filed with the State Secretary of Resources State Clearinghouse (SCH No. 97122030); and WHEREAS, the Draft Environmental Impact Report was circulated for a 45-day public/agency review period beginning on July 7, 1999 and ending on August 20, 1999. Public notice of the availability of the Draft Environmental Impact Report was published in a newspaper of general circulation and mailed to agencies. In addition, all persons who had requested notification were mailed a notice; and WHEREAS, the Planning Commission held a public heating on August 12, 1999 on the Draft Environmental Impact Report (DEIR). The Planning Commission received written and oral comments on the DEIR from the public, responsible agencies, and other governmental and private organizations; and WHEREAS, the City prepared responses to comments on environmental issues received during the public review period and at the public hearing, which responses clarify, amplify, and make minor corrections to the information contained in the Draft Environmental Impact Report, providing good faith reasoned analysis supported by factual information. The comments were published in the Final Environmental Impact Report, dated September 1999, and were distributed to or otherwise made available to the City Council, the Planning Commission, responsible agencies, and other interested parties; and WHEREAS, staff reports, dated August 12, 1999, September 2, 1999, September 15, 1999, September 22, 1999, and October 13 1999, incorporated herein by reference, were prepared for distribution to the City Council review, which reports describe and analyze the EIR and the General Plan Update; and WHEREAS, at a duly noticed public hearing on September 16, 1999, the Planning Commission recommended that the City Council certify the Environmental Impact Report set forth in Resolution 2568 -99; and WHEREAS, at a duly noticed public hearing on September 22, 1999 and October 13, 1999, the City Council considered certification of the Environmental Impact Report, consisting of the Draft Environmental Impact Report and the Final Environmental Impact Report; and WHEREAS, the Environmental Impact Report considered a reasonable range of alternatives to the project that (1) offer substantial environmental advantages over the project, and (2) may be feasibly accomplished in a successful manner considering the economic, environmental, social, and technical factors involved; and WHEREAS, the Environmental Impact Report identified certain significant and potentially significant environmental impacts which could be mitigated to a level of less than significance, therefore mitigation findings are required pursuant to CEQA § 15091 upon a project approval; and WHEREAS, the City must adopt a specific program that will enable it to track compliance with the mitigation measures. Once approach is to use the yearly "state of the plan" report prepared for the city council pursuant to Government Code Section 65400 (b) as the reporting program for a new general plan; and WHEREAS, CEQA Section 21081.6 requires that where mitigation findings are made for significant and potentially significant environmental impacts, a mitigation monitoring and reporting program shall be prepared to ensure compliance with the mitigation during the project implementation; and WHEREAS, the location and custodian of the documents which constitute the record of proceedings upon which the City's decision on the General Plan were based is the City of South San Francisco, Planning Division, 315 Maple Avenue, South San Francisco, California, 94080; and WHEREAS, the mitigation measures identified in the Environmental Impact Report has been incorporated as policies in the General Plan. NOW, THEREFORE, BE IT RESOLVED THAT 1. The South San Francisco City Council having reviewed and considered the Environmental Impact Report, finds that it reflects the independent judgement of the City as the lead agency, and hereby certifies the Environmental Impact Report EIR-99-61 with revisions attached hereto as complete, adequate, and in compliance with CEQA. o The City Council adopts Exhibits A (comprising the Draft Environmental Impact Report and the Response to Comments, Final Environmental Impact Report) and Exhibit B attached hereto, which includes the mitigation findings and the Statement of Overriding Considerations. 3. The City Council adopts the Mitigation Monitoring and Reporting Program. The MMRP for this project shall be the "Annual General Plan Report" prepared for the City Council pursuant to Government Code Section 65400 (b) as the reporting program for the General Plan update. I hereby certify that the foregoing resolution was adopted by the City Council of the City of South San Francisco at the regular meeting held on the 13th day of October' 1999, by the following vote: AYES: Councilmembers Joseph A.
