HomeMy WebLinkAboutReso 23-2010RESOLUTION NO. 23-2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY TWO PROPERTIES (PARCEL 61418-1 AND PARCEL 61418-2) TO THE STATE OF CALIFORNIA FOR THE OYSTER POINT BOULEVARD INTERCHANGE PROJECT WHEREAS, on October 17, 2001, the City of South San Francisco ("City"), Peninsula Corridor Joint Powers Board, the San Mateo County Transit District, and the State of California ("State") entered into the Railroad Construction and Maintenance Agreement for the Oyster Point Interchange project ("Project"); and WHEREAS, pursuant to the Railroad Construction and Maintenance Agreement, the City is required to convey or reconvey any real property or interest without limit easements and utility licenses to the State needed in connection with the structural improvement to the Oyster Point Interchange; and WHEREAS, the City owns two parcels, known as Parcel 61418-1 and Parce161418-2 (the "Properties"), that are within the Oyster Point Interchange structure and related to the Project; and WHEREAS, no funding is required to the transfer of the Properties from the City to the State; and WHEREAS, administration costs for the project is included in the City of South San Francisco's 2009-2010 Capital Improvement Program; and WHEREAS, adopting the resolution will ensure the Properties be conveyed to the State to close the Project. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San Francisco that the City Council hereby authorizes the City Manager to convey the Properties to the State of California for the Oyster Point Boulevard Interchange Project. BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute any agreements or take any action necessary on behalf of the City Council related to the conveyance of the Properties to the State of California and consistent with this Resolution. I hereby certify that the foregoing Resolution was regularly introduced and adopted. by the City Council of the City of South San Francisco at a regular meeting held on the 24t" day of February, 2010 by the following vote: AYES: Councilmembers Pedro Gonzalez, Richard A.
