HomeMy WebLinkAboutReso 26-2010RESOLUTION NO. 26 -2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE A CONTRACT WITH THE SAN FRANCISCO BAY CONSERVATION AND DEVELOPMENT COMMISSION AND AMEND THE 2009 -2010 CAPITAL IMPROVEMENT PROGRAM BUDGET. WHEREAS, on October 19, 1993, the San Francisco Bay Conservation and Development Commission (BCDC) approved Permit No. M93 -40 to Dobbs International Services, Inc. ( "developer ") to authorize construction of a commercial building and parking lot on the shoreline adjacent to Colma Creek in the City of South San Francisco; and WHEREAS, it was determined that onsite public access would potentially harm wildlife and adjacent development prevented continuous access in the project vicinity, requiring the developer to deposit funds into an interest bearing account under the BCDC's name; and WHEREAS, the account currently has $61,634, which the BCDC will disperse to the City of South San Francisco ( "City ") to undertake the Bay Trail Improvement Project ( "Project "); and WHEREAS, the staff is requesting that the City Council authorize the Director of Public Works to execute a contract with the BCDC to accept $61,634 in funding for the Bay Trail Improvement Project (Haskins Way) and amend the 2009 -2010 Capital Improvement Program ( "CIP ") Budget to increase the budget for the Project to a total amount of $258,134 to reflect an allocation from the BCDC; and WHEREAS, executing the contract with BCDC and amending the CIP budget in an amount of $61,634 will allow staff to proceed with the reconstruction of the Bay Trail Improvement Project. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San Francisco that the City Council hereby authorizes the Director of Public Works to execute a contract with the San Francisco Bay Conservation and Development Commission to accept $61,634 in funding for the Bay Trail Improvement Project (Haskins Way) and amends the 2009- 2010 Capital Improvement Program budget for the Project to a total amount of $258,134 in order to reflect an allocation from the BCDC. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 10 day of March, 2010 by the following vote: AYES: Councilmembers Pedro Gonzalez, Richard A. Garbarino, and Karyl Matsumoto, Vice Mayor Kevin Mullin and Mayor Mark Addiego NOES: None ABSTAIN: None ABSENT: None
