HomeMy WebLinkAboutOrd. 1426-2010ORDINANCE NO. 1426-2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO STATE OF CALIFORNIA AN ORDINANCE REPEALING SECTION 2.18.020 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE, DISSOLVING THE SOUTH SAN FRANCISCO SURPLUS PROPERTY AUTHORITY WHEREAS, pursuant to Government Code Sections 40500 et seq., the City Council created the South San Francisco Surplus Property Authority (SPA) in 1983 to acquire, maintain and use surplus real property located within or contig;uc-us to the City from the federal government; WHEREAS, the City Council finds there is no 1on~;e~r a need for the SPA to function in the City of South San Francisco. NOW THEREFORE, the City Council of the City of South San Francisco, by two-thirds vote, does find and ORDAIN as follows: 1. The SPA is hereby deemed dissolved; 2. The SPA shall. transact no further business and exercise no further powers; 3. Any properties obtained by the SPA and remaining in its possession shall vest in the City; 4. Any net earnings of the SPA shall inure solely to the City; and 5. South San Francisco Municipal Code Section 2.18.020 is hereby repealed in its entirety. SECTION 2. SEVERABILITY If any provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this ordinance, including the application of such part or provision to other pE;rsons or circumstances shall not be affected thereby and shall continue in full force and ei:fect. To this end, provisions of this ordinance are severable. The City Council of the City of South San Francisco hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences,, clauses, or phrases be held unconstitutional, invalid, or unenforceable. SECTION 3. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the :names of those City Councilmembers voting for or against it, in the San Mateo Times, a rte~~vspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. * ~ * ~ x~ Introduced at a regular meeting of the City Council of the City of South San Francisco, held the 24th day of March, 2010.
