HomeMy WebLinkAboutOrd. 1427-2010ORDINANCE NO. 1427-2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO STATE OF (:ALIFORNIA AN ORDINANCE REPEALING SECTION 2.18.030 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE, DISSOLVING THE SOUTH SAN FRANCISCO INDUSTRIAL DEVELOPMENT AUTHORITY WHEREAS, pursuant to Goverrlment Code Sections 91500 et seq., the City Council created the South. San Francisco Industrial Development Authority (IDA) in 1984 to issue tax- exemptbonds on behalf of private companies interested in c;oiistructing industrial and/or research and development facilities, WHEREAS, the City Council finds there is no longer a need for the IDA to function in the City of South San Francisco. NOW THEREFORE, the City Council of the City of South San Francisco, by at least a two-thirds vote, does find and ORDAIN as follows: 1. The IDA shall transact no further business and exercise no further powers; 2. The offices of IDA shall be deemed vacated; 3. Any funds and properties obtained or owed to the IDA shall vest in the City; 4. Any net earnings of the IDA shall inure solely to the City; 5. South San Francisco Municipal Code Section. 2.18.030 is hereby repealed in its entirety; and 6. The City Council hereby assumes all liabilities of the II)A with relation to outstanding bonds, and shall provide written notice of such to any bondholders of outstanding bonds. SECTION 2. SEVERABILITY If any provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this ordinance, including the application of such part or provision to other pE;rsons or circumstances shall not be affected thereby and shall continue in full force and e~~fect. To this end, provisions of this ordinance are severable. The City Council of the City of South San Francisco hereby declares that it would have passed each section, :subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences,, clauses, or phrases be held unconstitutional, invalid, or unenforceable. SECTION 3. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the :names of those City Councilmembers voting for or against it, in the San Mateo Times, a rie~~vspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. * * * * ~ Introduced at a regular meeting of the City Council of the City of South San Francisco, held the 24th day of March, 2010.
