HomeMy WebLinkAboutReso 43-2010RESOLUTION NO. 43-2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR GRANT FUNDS FROM THE STATE OF CALIFORNIA SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) FOR RENOVATION OF WESTBOROUGH PARK WHEREAS, staff recommends authorizing the filing of an application for $1.2 million in grant funds from the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) for environmental enhancements during the renovation of Westborough Park; and WHEREAS, the Legislature of the State of California has provided funds for the program and the Strategic Growth Council has been delegated the responsibility for the administration of the grant program; and WHEREAS, said procedures and criteria established by the Strategic Growth Council require a resolution certifying the approval of application by the City Council before submission of said application to the State; and WHEREAS, the applicant, if selected, will enter into an agreement with the Sate of California to carry out the project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby approves the filing of an application for grant funds from the Safe Drinking Water Bond Act of 2006; and BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco, by adopting this resolution hereby states that: 1. The City certifies it will have sufficient funds to operate and maintain the project consistent with the land tenure requirements; or will secure the resources to do so; and 2. The City certifies it will comply with the provisions of Section 1.771.8 of the State Labor Code regarding payment of prevailing wages on projects awarded Proposition 84 funds; and 3. The City certifies, if applicable, the project will comply with any laws and regulations including, but not limited to, legal requirements for building codes, health and safety codes, disabled access laws, environment laws, and that prior to commencement of construction, all applicable permits will have been obtained; and 4. The City appoints the City Manager as agent of the City of South San Francisco to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned project. * * * * ~ I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 12th day of May, 2010 by the following vote: AYES: Councilmembers Pedro Gonzalez, Richard A.
