HomeMy WebLinkAboutReso 45-2010RESOLUTION NO. 45-2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION CONFIRMING AN INCREASE IN SOLID WASTE COLLECTION RATES AS SUBMITTED BY THE SCAVENGER COMPANY EFFECTIVE JULY 1, 2010 IS CONSISTENT WITH THE SOLID WASTE FRANCHISE AGREEMENT WHEREAS, the City Council approved a franchise agreement on July 9, 1997 with the South San Francisco Scavenger Company for collection and disposal of solid waste; and WHEREAS, Section 6.4 of the agreement stipulates that every third year a rate adjustment is to be based on a survey of 32 specific cities' refuse rates with the rate adjustment to be set at ninety- five percent (95%) of the average of the 32 cities' rates; and WHEREAS, Section 5.9 of the agreement, as amended on May 9, 2002, stipulates that the sludge hauling fees may increase annually by 80% of the Bay Area Consumer Price Index (CPI), and that increase is 1.94 percent; and WHEREAS, in recognition of challenging financial times due to recessionary pressures, the Scavenger Company has offered to delay the residential ratepayer CPI adjustment of 1.94 percent in 2010/11 unti12011/12; and WHEREAS, the deferred portion of the 2009/10 residential ratepayer increase is now due in 2010/11 with rates as shown in Exhibit A; and WHEREAS, the calculations and the rates of the C~PI adjustment have been verified by Finance Department staff, and a complete fee schedule is attached hereto as Exhibit A. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby accepts the increases in the solid waste disposal and collection fees as shown in Exhibit A as consistent with the terms of the franchise agreement. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 26th day of May, 2010 by the following vote: AYES: Councilmembers Pedro Gonzalez, Richard A.
