HomeMy WebLinkAboutReso 58-2010RESOLUTION NO. 58-2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ESTABLISHING INCREASED SEWER RATES EFFECTIVE FISCAL YEAR 2010-2011, AMENDING THE MASTER FEE SCHEDULE TO INCLUDE THE RATES; AND ADOPTING A REPORT OF ANNUAL SEWER RENTALS OR CHARGES FOR FISCAL YEAR 2010-2011. WHEREAS, by Chapter 14.12 of the South San Francisco Municipal Code the City Council is authorized to establish sewer rates by resolution; and WHEREAS, on June 24, 2009, the City Council reviewed the implementation of the 5- year rate increases of 20% for 2009-2010, 10% for 2010-2011, 5% for 2011-2012, and 0% for 2012-2013 and 2013-2014, after a properly noticed public hearing at which there was not a majority protest, the City Council approved the sewer rate increase to finance improvements to the City's sewer collection, pumping and treatment facilities; and WHEREAS, in June of 2010, as required by law, notice of the proposed increase and the public hearing was published in a newspaper of general circulation; and WHEREAS, the City Council has given notice and on June 23, 2010, held a public hearing as required by law on the subject sewer rates; and WHEREAS, the rates reflected in the report of Annual Sewer Rentals and charges are consistent with the five-year financing plan. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of South San Francisco hereby approve the schedule of rates set forth in the attached Exhibit "A" which implements the previously approved financing plan, and hereby amends the City's Master Fee Schedule to include the rates. BE IT FURTHER RESOLVED that the City Council hereby adopts the Report of Annual Sewer Rentals and Charges for Fiscal Year 2010-2011, and directs that the rates so established shall be collected on the official tax assessment roll, together with real property taxes, and that the amount shall constitute liens upon the properties which shall be effective at the same time and to the same extent as is provided for by law in the case of real property taxes, with like penalties for delinquencies. * * * ~ I hereby certify that the foregoing Resolution was regularly introduced and ado~ted by the City Council of the City of South San Francisco at a regular meeting held on the 23r day of June, 2010 by the following vote: AYES: Councilmembers Pedro Gonzalez, Richard A. Box 711 South San Francisco, CA 94083 NOTICE OF PROPOSED SEWER RATE INCREASE and of PUBLIC HEARING for the CITY OF SOUTH SAN FRANCISCO THE CITY OF SOUTH SAN FRANCISCO GIVES NOTICE that: 1. The City is proposing to increase sewer rates. The purpose of the proposed increase is to finance improvements to the City's sewer collection, pumping and treatment facilities. The improvements are necessary to comply with State and Federal water quality requu-ements, to reduce the overflow of raw sewage during the wet weather season events and to provide additional reliability of the City's facilities. The improvements include rehabilitation of sewer collection lines, upgrades to pump stations, and upgrades to the treatment plant as well as all related administrative and incidental costs, including the costs of financing the sewer improvements. 2. A description of how the rates are calculated and the proposed schedule of rate increases are available at the Water Quality Control Plant located at 195 Belle Air Road, South San Francisco. If the rate increases are approved, it is proposed that they will commence to be collected with the property taxes beginning with Fiscal Year 2010-11 and will continue to be collected until otherwise modified by the City. The sewer rates will not exceed the maximum amounts shown without another written notice to the property owners. 3. Before taking final action on the proposed rate increase, the City Council will hold a PUBLIC HEARING on Wednesday, June 23, 2010, at 7:00 p.m. in the City Council Chambers, Municipal Services Building, 33 Arroyo Dr., So. San Francisco. The Public Hearing will be for hearing public testimony on the proposed sewer rate increase. The Council may continue the hearing from time to time without further written notice. 4. Any property owner may file with the City Clerk, at any time before the end of the Public Hearing, written comments regarding the proposed rate increase which will be made present and heard at the public meeting. (1 unit equals 748 gallons.) -8- REPORT OF SEWER RENTAL CHARGES FOR 2010-2011 IN ACCORDANCE WITH CHAPTER 14.12 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE In accordance with Chapter 14.12 of the South San Francisco Municipal Code, the following report prepared as of June 1, 2010 is submitted. The report describes the procedure of charging those parcels of real property, which directly receive the benefits of municipal sanitary sewer services and the amount of the annual charge or rental, which will be imposed against each parcel for Fiscal Year 2010-2011. 1. Summary of Rentals or Charges. The following is a summary of the annual rental or charges for 2010-2011. Sewer Rental Account File. This report refers to and incorporates by reference the report entitled "Rate Determination and Revenue Program Summary," prepared by and on file at the City of South San Francisco Water Quality Control Plant. The report summarizes the 2010-2011 sewer rental charge that will be proposed to the City Council on June 23, 2010. Upon adoption of the proposed charges, or amendments thereto, a report entitled "City of South San Francisco Sanitary Sewer Charges", prepared by Engineering Data Services, Los Altos, California, will be completed. The report will describe by Assessor's Parcel Number each parcel of real property receiving directly the benefits of municipal sanitary sewer service and the amount of annual charge or rental imposed against each parcel for fiscal year 2010-2011. All of these documents, including this report shall be filed with the County Tax Collector or Auditor.
