HomeMy WebLinkAboutReso 40-1999RESOLUTION NO. /,0-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO CALIFORNIA, CALLING FOR THE FORMATION OF A PROJECT AREA COMMITTEE FOR THE SECOND AMENDMENT TO THE EL CAMINO CORRIDOR REDEVELOPMENT PROJECT AND ADOPTING PROCEDURE THEREFOR WHEREAS, the Redevelopment Agency of the City of South San Francisco has prepared the Second Amendment to the Redevelopment Plan for the El Camino Corridor Redevelopment Project; and WHEREAS, Section 33385.3 of the Community Redevelopment Law ("CRL") provides that when an agency proposes to amend a redevelopment plan to add territory in which a substantial number of low- and moderate-income persons reside and grant eminent domain authority to the agency, the agency shall establish a project area committee pursuant to Section 33385 of the CRL; and WHEREAS, Section 33385 of the CRL provides that the legislative body of a city shall call upon the residents and existing community organizations in a redevelopment project area, within which a substantial number of low- and moderate-income persons reside and the redevelopment plan contains eminent domain authority over properties where such persons reside, to form a project area committee and to establish the procedure therefor; and WHEREAS, the Agency, in connection with the Second Amendment, proposes to add territory to the El Camino Corridor Redevelopment Project ("Second Amendment Area", "Added Area", "El Camino Corridor Added Area") in which a substantial number of low- and moderate-income persons reside and grant the authority to the Agency to acquire by eminent domain property on which persons reside in the added territory; and WHEREAS, although the displacement of residential occupants by direct action of the Redevelopment Agency may occur and would only occur when necessary to achieve project objectives, and only in accord with the procedure required by law; nevertheless, a substantial number of low- and moderate- income families are subject to displacement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco, California, as follows: Section 1. The City Council hereby finds and determines that the E1 Camino Corridor Added Area contains a substantial number of low- and moderate-income persons, and that the Redevelopment Plan for the E1 Camino Corridor Redevelopment Project, as proposed to be amended by the Second Amendment, will grant the provision for eminent domain authority over the El Camino Corridor Added Area. Section 2. The City Council hereby calls upon the residents, business owners and existing community organizations within the El Camino Corridor Added Area to form a project area committee. Section 3. The "Procedure for Formation of Project Area Committee and Communitywide Procedures for Election of Members Thereof for the El Camino Corridor Redevelopment Project Added Area," attached to this Resolution as Attachment "A" and incorporated herein by this reference, is hereby adopted. Section 300 of the attached procedure provides for publicizing the opportunity to serve on the PAC. ca The agency shah provide written notice by first-chss mail to all residents, businesses, and community organization, including religious institutions and other nonprofit organizations, within the project area at least 30 days prior to the formation of the project area committee. The agency shah conduct establishment of; functions committee. a minimum of one public meeting to explain the of; and opportunity to serve on, the project area The agency shah provide published notice of aH meetings, hearings conducted by or on behalf of; the agency or city council relative to the formation and selection of the project area committee. The agency shah provide written notice to all residents, businesses, and community organizations in the project area of aH meetings, hearings, conducted by or on the behalf of the agency or city council relative to the formation and selection of the project area committee. ca The agency shah also provide other forms of notice appropriate to the community in which the project area is to be established, as determined by the agency. ca The number of community organizations and the method of selection, which may include election, appointment, or both. ca Any other forms of assistance which the city council requires in connection with the formation of the project area committee. The CRL further provides for PAC membership and is covered in Section 400 of the Procedures. The PAC shah include , when appplicable, elected representatives of residential owner occupants, residential tenants, business owners, and existing organizations, including religious institutions within the Added Area. The Procedure calls for a PAC consisting of seven (7) members with the following representation: residential tenants: 4 members, business owners: 2 members, and representatives of community organizations: 1 member. The procedure also spells out the process for filling vacancies on the PAC. Section 500 provides the procedures for PAC elections. It spells out the eligibility requirements for each classification of representation, ff a person is selected who has multiple qualifying conditions, that person may only have one vote on the PAC. The Section further describes the Election meeting and the Election Process for the selection of PAC members. Page 2 Section 4. The Executive Director (or designee) of the Redevelopment Agency of the City of South San Francisco is hereby authorized and directed to take all steps and actions necessary and appropriate to implement the Procedure and form a Project Area Committee. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a Regular meeting held on the 24th day of March, 1999, by the following vote: AYES: Councilmembers Joseph A.
