HomeMy WebLinkAboutOrd. 1431-2010ORDINANCE NO. 1431-2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO STATE OF CALIFORNIA AN ORDINANCE .AMENDING SECTION 8.16.040 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE REGARDING LOCATION OF RECEPTACLES ON DESIGNATED COLLECTION DAYS WHEREAS, in 1997 the City adopted Chapter 8.16 of the South San Francisco Municipal Code regarding Solid Waste -Scavenger Services; and WHEREAS, the trash collection franchisee now uses an automated trash can retrieval system which requires trash receptacles to be placed at the curbside; and WHEREAS, the City desires to amend Section 8.16.040 of the South San Francisco Municipal Code regarding the placement of receptacles on designated collection days in order have the municipal code be consistent with current collection practices. NOW, THEREFORE, the City Council of the City of South San Francisco does ORDAIN as follows: Section 1. Section 8.16.040 of the South San Francisco Municipal Code is hereby amended as follows: 8.16.040 Location of receptacles on designated collection days. Solid waste receptacles shall not be placed within the limits of any street, road, avenue, public way, alley or public place, ot• in a manner which blocks a sidewalk or constitutes a public nuisance in complying with the provisions of this section. On the designated collection date, solid waste receptacles shall be placed as follows: (a) Single-Family, Duplex and Triplex Residential Properties. Solid waste receptacles for single-family, duplex, and triplex residential properties shall be placed 2-feet apart and 3-feet away from any vehicle or obstacle with the cart wheels against the curb and handles facing the residence. An alternate location may be permitted for the following: (1) The premises for which such a location may constitute a nuisance; (2) Premises far which placement against the curbside is not possible; and (3) Premises for which the owner or occupant has subscribed for backyard pickup service. (b) Multiple Unit Residential Properties, Commercial and Industrial Properties and Institutional Properties. Solid waste receptacles shall be located in a place on the premises which is readily accessible for removal and emptying by the scavenger. SECTION 2. SEVERABILITY If any provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this ordinance, including the application of such part or provision to other persons or circumstances shall not be affected thereby and shall continue in full force and effect. T o this end, provisions of this ordinance are severable. The City Council of the City of South San Francisco hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable. SECTION 3. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the San Mateo Times, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. ~ ~ * * ~ Introduced at a regular meeting of the City Council of the City of South San Francisco, held the 14th day of July, 2010.
