HomeMy WebLinkAboutReso 130-1997 RESOLUTION NO. 130-97 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING A COOPERATION AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND THE SOUTH SAN FRANCISCO REDEVELOPMENT AGENCY RELATED TO IMPLEMENTATION OF THE PREVAILING WAGE POLICY FOR REDEVELOPMENT AREA PROJECTS WHEREAS, the Agency has recently adopted a Prevailing Wage Policy applicable to redevelopment area projects which meet certain standards; and WHEREAS, enforcement of said policy requires cooperation between the City of South San Francisco and the Redevelopment Agency of South San Francisco; and WHEREAS, the City desires to enter into the Cooperation Agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that it hereby approves the Cooperation Agreement attached hereto as Exhibit A. BE IT FURTHER RESOLVED that the Mayor is hereby authorized to sign the Cooperation Agreement on behalf of the City. RSO I EXHIBIT A TO RESOLUTION NO. 130-97 COOPERATION AGREEMENT This COOPERATION AGREEMENT is entered into and shall be effective as of , by and between the REDEVELOPMENT AGENCY of the CITY OF SOUTH SAN FRANCISCO ("Agency") and the CITY OF SOUTH SAN FRANCISCO ("City"). A. On , 1997, the Agency adopted a Prevailing Wage Policy to promote employment opportunity consistent with area wage standards and to further red'evelopment within the City of South San Francisco. B. Pursuant to Health and Safety Code Section 33220, the City and Agency now desire to enter into this Cooperation Agreement with respect to certain planning and zoning activities of the City to cooperate with and aid the Agency's prevailing wage policy. NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby aclmowledged, the proxies agree as follows: 1. The City will require a project applicant to enter into an agreement to comply with the Agency's Prevailing Wage Policy prior to approval of zoning action, subdivision map, use pemfit, grading or building permit for any project which is required to pay prevailing wages pursuant to the Agency's policy. 2. In any Development Agreement which the City enters into pursuant to Government Code Section 65864 et seq. for a project which is located within a redevelopment area, the City will require payment of prevailing wages pursuant to the Agency's policy. 3. The City will withhold a Certificate of Occupancy until the person undertaking a project has posted with the Agency a bond sufficient to cover the amounts of any wages which allegedly should have been paid pursuant to the Agency policy but xvhich were not paid, provided that Agency has reasonable evidence to support the claim that such wages were not paid. I IN WITNESS WHEREOF, the Agency and the City have executed this Agreement as of the date set forth above.
