HomeMy WebLinkAboutReso 4-1995RESOLUTION NO. 4-95 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION CONCURRING WITH THE TOLLING OF 984 DAYS FOR LITIGATION WHICH RESULTS IN EXTENDING THE TERRABAY SPECIFIC PLAN AND DEVELOPMENT AGREEMENT TO AUGUST 12, 1995 WHEREAS, the Terrabay Specific Plan provides for extension by operation of law; and "WHEREAS, on April 28, 1983 a petition was filed in the case of Pollard vs. the City of South San Francisco, et al. and ended on January 7, 1986 with a decision rendered and filed in San Mateo County Superior Court, representing a tolling period of 984 days; and WHEREAS, the City Council has received all material presented, has considered all evidence presented, and concurs with the recommendations contained in the Staff Report on January 25, 1995; and WHEREAS, the extension of the Terrabay Specific Plan and Development Agreement are consistent with the goals, policies and objectives of the General Plan and the provisions of the South San Francisco Municipal Code. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco concurs with Sunchase/Sterling Pacific Company that the Terrabay Specific Plan and Development Agreement have been tolled by operation of law for 984 days until August 12, 1995. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 25th day of Janua~ , 1995 by the following vote. AYES: Councilmembers Jack Drago, Joseph A. Fernekes, John R. Penna, Roberta Cerri Teglia and Mayor Robert Yee NOES: None ABSTAIN: No ne ABSENT: None City Clerk
