HomeMy WebLinkAboutReso 21-1995RESOLUTION NO. 21-95 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF THE CITY COUNCIL OF SOUTH SAN FRANCISCO CONCURRING WITH THE TOLLING FOR AN ADDITIONAL 549 DAYS FOR LITIGATION WHICH RESULTS IN EXTENDING THE TERRABAY SPECIFIC PLAN AND DEVELOPMENT AGREEMENT TERMINATION DATES TO FEBRUARY 14, 1997. WHEREAS, the Terrabay Specific Plan provides for extension by operation of law; and WHEREAS, based on.prior tolling acknowledgements, the current expiration date of the Terrabay Specific Plan and Development Agreement is August 12, 1995; and Whereas, based on the case of W.W. Dean v. City of South San Francisco and specifically the intervention into that case by South San Francisco citizens for Our Mountain, implementation of the project was delayed pending a final decision and possible election for a period of 549 days beyond the previously recognized tolling period; and WHEREAS, tolling of the Terrabay Specific Plan and Development Agreement are consistent with the goals, policies, and objectives of the General Plan; WHEREAS, concurrence with the additional tolling period is a ministerial action and is therefore exempt from CEQA analysis pursuant to Public Resources code section 21080(b)(1). NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of South San Francisco concurs with Sunchase/Sterling Pacific that the Terrabay Specific Plan and Development Agreement have been tolled by operation of law for an additional 549 days until February 14, 1997. * * * * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 12th day of April , 1994, by the following vote: AYES: NOES: ABSTAIN: ABSENT: Councilmembers Joseph A.
