HomeMy WebLinkAboutReso 71-1995 RESOLUTION NO. 71-95 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ACCEPTING AND APPROVING AN AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND THE POLICE ASSOCIATION, FOR THE PERIOD JANUARY 1. 1995 THROUGH DECEMBER 31. 1995 WHEREAS, the City Council of the City of South San Francisco has recognized the Police Association as the employee organization representing a majority of those employees working in classifications in representation Unit C; and WHEREAS, the representatives of the City and the representatives of the Police Association have personally met and conferred and freely exchanged information, opinions and proposals; and WHEREAS, the representatives of the City and the representatives of the Police Association have reached agreement on those wages and conditions of employment which are to be in effect during the period January 1, 1995 through December 31, 1995 for employees in representation Unit C; and WHEREAS, the City's representative recommends that the agreement be accepted and approved by the City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that it accepts and approves the agreement between the City of South San Francisco and the Police Association and attached as Exhibit "A", which sets forth those wages and conditions of employment to be in effect during the period January 1, 1995 through December 31 1995 for employees working in classifications in representation Unit C, and which shall be binding upon the City, upon the Police Association and upon the employees covered therein. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regul ar meeting held on the 26th day of duly ,1995 by the following vote. Penna City Clerk RESOLUTION NO. 71-95 Proposal for a new Memorand-m of Understnndlng Between City of South San Francisco and South San Francisco Police Association The memorandum covering the period January 1, 1994 through December 31, 1994 is to be renewed without change except for the following: January 1, 1995 through December 31, 1995 Bo HEAr,TH INSURANCE: Article 7, Section A under Provisions for Sworn Personnel and Article 2, Section 3.A under Provisions for Non-Sworn Personnel will add: Health Imurance for Employees Who Retire: Subject to the terms and conditions of the City's contracts with health insurance carriers, an employee who retires on a service or an industrial disability or non-industrial disability retirement from the City's service shall be provided the opportunity to continue his or her health immrance coverage with one of the City's plans subsequent to the date of his or her retirement. The City shall continue to pay the premium costs for the employee only and the retiring employee shall bear the premium costs for his or her dependents. Co a) The City agrees to allow the spouse and dependents of a deceased employee/retiree to purchase medical insurance from a City-provided medical plan at the City's premium rate, provided: (1) (2) there is no cost to the City; the health provider does not require a City contribution; and (3) the City is held harmless if the coverage is discontinued. INSURANCF.: Article 7 B under Provisions for Sworn Personnel and Article 2, Section 3 D under Provisions for Non-Sworn Personnel will add: The City agrees to allow the spouse and dependents of a deceased employee/retiree to purchase dental insurance from a City provided dental plan at the City's premium rate, provided: (1) there is no cost to the City; (2) the dental provider does not require a City contribution; and De Eo Fo (3) the City is held harmless if the coverage is discontinued. VISION INSURANCF.: Article 7 C under Provisiom for Sworn Personnel and Article 2, Section 3 C under Provisions for Non-Sworn Personnel will add: The City agrees to allow the spouse and dependents of a deceased employee/retiree to purchase vision insurance from a City provided vision plan at the City's premium rate, provided: (1) there is no cost to the City; (2) the vision provider does not require a City contribution; and (3) the City is held harmless if the coverage is discontinued. VACATION BUY BACK FOR NON SWORN: Article 3, Section 2 A under Provisions for Non-Sworn Personnel will add: Employees who have scheduled a minimum of twelve (12) vacation days during each calendar year shall be permitted to receive the cash value of up to six (6) days of unused but accrued vacation. Requests for payment of accrued vacation may be processed within 45 days of scheduled leave. UNIFORM A!,I,OWANCE: Article 5 under Provisions for Non-Sworn Personnel and Article 8, Section 2 under Provision for Sworn Personnel shall be deleted and in its place: Uniform allowance distribution will be made in two equal increments per fiscal year. The distributions will occur on the f~rst pay periods in November and in May. With the allowance they receive officers and civilian personnel shall be responsible for procuring and maintaining their uniforms and equipment as listed ia the current General Order and Procedures Manual. - If at any time the Chief of Police feels an officer or a civilian's appearance in uniform is not acceptable, the Chief can suspend the current payment procedure and institute a reimbursement method of uniform allowance a~tration. The Chief's decision is discretionary and cannot be appealed; nor can a grievance be filed. However, prior to the Chiefs final decision notice will be given to the Police Association President who will be allowed fifteen (15) days to remedy the noticed problem. At the end of the fifteen (15) day period, whether the problem (s) are remedied or not, the Chief of Police will maintain complete discretion concerning the decision whether to terminate the uniform allowance program as set forth in the above paragraph. The mason given does not have to be anything more than some personnel have let their uniforms deteriorate to a point where they are not acceptable. Uniform allowance does not commence until the second year of employment with the Deparunent. After the first year of employment is completed, the individual will receive the uniform allowance at the next payment period. If the year anniversary is after the last payment month, then there will be no reimbursement for that year. If the anniversary falls after the first payment, employee shall receive one-half of that years allowance. When an officer requests, the City will purchase the officer a bullet proof vest of the officer's choice. Those individuals who have had a bullet proof vest purchased will have the cost reimbursed to the City out of their uniform allowance ia four equal payments over a two year period. The initial uniform and equipment purchase at hire shall be borne by the City, The City will provide a bullet proof vest, which cost will be reimbursed on a prorated basis commencing in the second year of employment. Go Ii. PROMOTIONS: Article 2, Section 5 under Provisions for Non-Sworn personnel will add: D. PROMOTIONS An employee who is promoted from one classification to a higher classification, with the Unit shall have his or her rate set at the first step of the new classification or at the rate for the step five percent (5%) higher than the rate earned by the employee prior to the promotion, whichever new rate is higher. Prior to advancing to the next step of the new schedule, the promoted employee will be required to complete the specified time in each step of the new classification commencing with the date of promotion. RM DISAlqII,FrY: Article 7 E under Provisions for Sworn Personnel will be modified as follows: The paragraph which now reads Eo l,orlg-Terrn Disability Insurance Subject to the terms and conditions of the City's contract with Standard Insurance Company of Portland, Oregon, eligible employees shall be provided Long-Term Disability Insurance Coverage which provides for payment of up to two-thirds (2/3) of the base salary of an employee who qualifies for such payment or who qualifies for some lesser payment under provisions of the Plan. Thc Long-Term Disability Insurance Plan shall be provided to employees at no premium costs to thc employees. Coverage shall become effective on the first day of thc month following enrollment and terminate on thc day an employee separates from City employment. . will be deleted. In its place the following paragraph will be inserted. All Sworn Personnel in this unit shall be required to pay for and must maintain Long-Term Disability ~ce coverage subject to the terms and conditions of the South San Francisco Police Association's contract with the California Law Enforcement Association. Eligible employees shall be provided Long-Term' Disability In.~urance coverage which provides for payment of up to three-fourths (3/4) of the base salary of an employee who qualifies for such payment under provisions of the Plan. Such coverage will become effective July 1, 1995. Coverage shall become effective on the first day of the month following enrollment and terminate on the day an employee separates from City employment. Paragraph 1. "Application for Benefits" shall be modified to read 1. Application for Benefits · An employee who is disabled from the performance of the full scope of the usual and customary duties of his or her classification as the result of an injury or illness and who has utilized all accrued paid leave and sick leave for which the employee is eligible up to the sixtieth (60) calendar day of disability, may file an application for Long-Term Disability ln.mrance benefits in accordance with the requirements of the South San Francisco Police Association's Long-Term Disability Insurance Policy. All other language in this section will remain intact. Since all sworn personnel will now pay for and maintain their long term disability immxance, the City agrees to provide each sworn officer an amount equivalent to $29.54 a month plus an additional $14.50 per month will be given to the Police Association on behalf of each sworn officer for the long term disability coverage with that amount to be included on the officers W-2 tax statement, (,-.~--~ This benefit will take effect once the coverage is in place. MATERNITY I,F, AVE: Article 6, Section C shall be added to include the following: Four months leave will be provided in accordance with State Law.
