HomeMy WebLinkAboutReso 140-1994RESOLUTION NO. 140-94 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF INTENTION TO GRANT A FRANCHISE TO SANTA FE PACIFIC PIPELINE WHEREAS, Santa Fe Pacific Pipeline has filed a franchise application with the City of South San Francisco to construct, maintain, and operate a pipeline system transmitting oil or products thereof through designated public streets of the City of South San Francisco; and WHEREAS, the Interim Public Works Director and Acting City Manager have recommended adoption of the resolution of intention to grant the franchise. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco, that: 1. It does hereby declare its intention to grant the franchise application requested by Santa Fe Pacific Pipeline to install, maintain, and operate an 8-inch pipeline to be used for the transmission of oil and oil-related products; and 2. It hereby establishes Wednesday, January 11, 1995 at 7:30 p.m. at the South San Francisco Municipal Services Building, 33 Arroyo Drive, South San Francisco, California as the place when and where all persons having any objection to the granting of the franchise may appear before the legislative body and be heard thereon; and 3. It hereby directs the City Clerk to publish the notice attached hereto as Exhibit "A" at least once within fifteen (15) days after the passage of the resolution in a newspaper of general circulation within the municipality. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 14th day of December , 199 by the following vote. Penna ATTEST: ~~C ity~C~l erk~~ RESOLUTION NO. 140-94 EXHIBIT A NOTICE OF INTENTION TO APPROVE FRANCHISE AGREEMENT The City Council of the City of South San Francisco will hold a public hearing related to Santa Fe Pacific Pipeline's request for a franchise agreement to transmit oil and oil products through an 8-inch pipeline along certain specified public rights-of-way. The public hearing will occur at the South San Francisco Municipal Services Building, 33 Arroyo Drive, South San Francisco, California on Wednesday, January 11, 1995 at 7:30 p.m. Under the terms of the franchise, Santa Fe Pacific Pipeline and its successors and assigns will pay South San Francisco a franchise fee consistent with Public Utilities Code Sections 6231.5 (.176 cents per lineal foot in 1988 dollars). Said fee shall be paid to the city on an annual basis for the length of the franchise which is established at 40 years.
