HomeMy WebLinkAboutReso 97-2010RESOLUTION NO. 97-2010 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE AGREEMENT WITH CFS 2907 SAN FRANCISCO LLC PERTAINING TO A CITY OWNED PARCEL LOCATED ADJACENT TO SAN MATED AVENUE, SOUTH SAN FRANCISCO. WHEREAS, the City of South San Francisco ("City") adopted Resolution 146-83 on October 19, 1983 authorizing the City Manager to execute a revocable license agreement ("Original License") to lease said parcel of land to Parking Company of America Airports ("PCAA") in the amount of Eight Hundred Fifty Dollars ($850.00) per month, and; WHEREAS, the City adopted Resolution 104-2005 on September 28, 2005 authorizing the City Manager to execute an amended revocable license agreement to lease said parcel of land to PCAA in the amount of Three Thousand Nine Hundred Twenty 'Three Dollars ($3,923.00) per month; and WHEREAS, the Original License was assigned from PCAA to CFS 2907 San Francisco LLC, delivered in connection with that certain Sale Order entered by the United States Bankruptcy Court for the District of Delaware (In re PCAA Parent, LLC, et al, Case No. 10-10250 (MFW)); and WHEREAS, the Original License has expired, and the City and CFS 2907 San Francisco LLC desire to set forth their agreement regarding use of the said parcel in a new revocable license agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby approves the Revocable; License Agreement attached hereto as Exhibit A. BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the agreement on behalf of the City of South San Francisco. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 10th day of November, 2010 by the following vote: AYES: Councilmembers Pedro Gonzalez, Richard A.
