HomeMy WebLinkAboutReso 11-1994 RESOLUTION NO. 11-94 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ACCEPTING AND APPROVING AN AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND THE INTERNATIONAL UNION OF OPERATING ENGINEERS, STATIONARY ENGINEERS LOCAL 39, AFL-CIO, UNIT D, FOR THE PERIOD JANUARY 1, 1994 THROUGH DECEMBER 31. 1994 WHEREAS, the City Council of the City of South San Francisco has recognized the International Union of Operating Engineers, Stationary Engineers Local 39, AFL-CIO, as the employee organization representing a majority of those employees working in classifications in representation Unit D; and WHEREAS, the representatives of the City and the representatives of the International Union of Operating Engineers, Stationary Engineers Local 39 have personally met and conferred and freely exchanged information, opinions and proposals; and WHEREAS, the representatives of the City and the representatives of Stationary Engineers Local 39 have reached agreemen~ on those wages and conditions of employment which are to be in effect during the period January 1, 1994 through December 31, 1994 for employees in representation Unit D; and WHEREAS, the City's representative recommends that the agreemen't be accepted and approved by the City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that it accepts and approves the agreement between ~he City of South San Francisco and the International Union of Operating Engineers, Stationary Engineers Local 39 and attached as Exhibit "A", which sets forth those wages and conditions of employment to be in effect during the period January 1, 1994 through December 31, 1994 for employees working in classifications in representation Unit D, and which shall be binding upon the City, upon the International Union of Operating Engineers, Stationary engineers Local 39 and upon the employees covered therein. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 9th day of February , 1994 by the following vote. Fernekes NOES: None ABSTAIN: N0ne ABSENT None Engine~rs.Agt ATTEST: city Clerk RE SOL ~T~I, ,O,N,., ,N.,.O., A,1- 94 I:.AM 11~ 1/ ~/-~ AGREEMENT BETWEEN THE INTERNATIONAL UNION OF OPERATING ENGINEERS, STATIONARY ENGINEERS LOCAL 39, UNIT D AND THE CITY OF SOUTH SAN FRANCISCO The parties having met and negotiated pursuant to Government Code Section 3500 et seq. do hereby agree to the following changes to the Memorandum of Understanding in the terms and conditions of employment from the effective date of this agreement to December 31, 199~. TERM: The term of the agreement will extend from January 1, 1994 through December 31, 1994. WAGES: Article 6, Section A shall be revised to read as follows: ARTICLE 6. SALARIES A. WAGE RATES Effective with the pay period including January 1, 1994, the salary schedule for all Unit members shall be increased by one and one-half percent (1.5%). Article 6, Section B (1) shall be expanded to incorporate the following: B. PREMIUMS 1. Premium Certification An employee in the classification of Mechanic or Assistant Mechanic/Machinist who has successfully completed the California Water Pollution Control Association Examination and who possesses a Grade I Certification in Mechanical Technology shall be compensated at a rate Z% higher than the rate for which the employee qualifies pursuant to the salary schedule in effect; and an employee in the classification of Mechanic or Assistant Mechanic/Machinist who has successfully completed the California Water Pollution Control Association Examination and who possesses a Gr&dm II Certification in Mechanical Technology shall be compensated at a range of 3% higher than the rate for which the employee qualifies pursuant tot he salary schedule in effect. An employee in the classification of Mechanic Electrician or Assistant Electrician/Mechanic who has successfully completed the California Water Pollution Control Association Examination and who possesses a Grade I Certification in Electrical/Instrumentation shall be compensated at a rate 2% higher than the rate for which the employee qualifies pursuant to the salary schedule in effect; and an employee in the classification of Mechanic Electrician or Assistant Electrician/Mechanic who has successfully completed the California Water Pollution Control Association Examination and who possesses a Grade II Certification in Electrical/Instrumentation shall be compensated at a rate 3% higher than the rate for which the employee qualifies pursuant to the salary schedule in effect. go An employee in the classification of Source Control Inspector or Senior Source Control Inspector who has successfully completed the California Water Pollution Control Association Examination and who possesses a Grade II Certification in Industrial Waste Inspection shall be compensated at a rate 2% higher than the rate for which the employee qualifies pursuant tot he salary schedule in effect; and an employee in the classification of Industrial Waste Inspector or Senior Industrial Waste Inspector who has successfully completed the California Water Pollution Control Association Examination and who possesses a Grade III Certification in Industrial Waste Inspection shall be compensated at a rate 3% higher than the rate for which the employee qualifies pursuant to the salary schedule in effect. Signed this day of , 1994 by: FOR THE CITY OF SOUTH SAN FRANCISCO FOR THE UNION: (Operating Engineers; Local 39, Unit D) RESOLUTION NO. 11-94 EXHIBIT "B" The City Council, City Manager, Public Works Director and WQCP Superintendent have reviewed the management/operations concerns raised by the representatives of Stationary Engineers Local 39 and presented to the Management Negotiating Team in the course of deliberations on a new Memorandum of Understanding. Recognizing the importance of these concerns to the membership of Local 39, but further acknowledging that such matters are not subject to Meet and Confer, the City Council and Management nonetheless wish to convey a firm commitment to address these concerns as follows: Se Management will insure that vacant positions are filled within six months of becoming available, except where budget considerations require delays of a longer duration. The Laboratory Supervisor will serve as Safety Coordinator for the WQCP. A health/safety consultant is about to be selected to review safety manuals/programs in place. An ongoing consultation arrangement will be put in place to allow for assistance as safety concerns arise which require evaluation and action. The Safety Coordinator will continue as the WQCP representative to the City Safety Committee. Improved communication between Management and members of Local 39 will be facilitated through regularly scheduled staff meetings. Weekly staff meetings will be held involving Supervisors and respective crews. The Superintendent will schedule monthly meetings with Plant staff. The Director of Public Works will continue monthly plant visits and quarterly staff meetings with all Plant personnel. The Operations Supervisor will serve as Training Coordinator. Training will be provided to all personnel to assist in establishing a level of confidence in monitoring and/or maintenance of new plant equipment. At such times that the regular workload may preclude the use of existing personnel to undertake special or emergency maintenance projects, Management will consult with Unit members prior to the contracting out of Unit work. Plant staff have been and will continue to be offered overtime opportunities as they arise. Management is responsible for monitoring the backlog of work to insure that staff resources are not overburdened. Enqineering staff will actively involve plant staff in design/construction issues with greater emphasis to be placed on predesign consultation. Ongoing feedback is to be solicited throughout work in progress to determine whether suqgested items should or should not be included. The Maintenance Supervisor will assume the role of Preventive Maintenance (PM) and Work Order (WO) Systems Coordinator. This position will serve as coordinator for purposes of developing an 0 & M Manual. PM and WO software vendors are currently being evaluated. In February, the decision will be made to develop a system in-house or use a packaged software system. Input will be solicited from staff as the evaluation is made. In March, details will be finalized concerning the workplan and start-up will be scheduled in April. The 0 & M Manual is to be included in the 1994 CIP work program. Computer training will be provided as part of the introduction of any new PM/WO systems. Equipment training will also be provided for all staff in conjunction with the development of an O & M Manual. Follow Ups On Plant Rehab Project Replacement of temporary 480V cable is to be included in 1994 work plan for scheduled completion this summer. The cogeneration cooling system will be evaluated by the designers and recommendations developed for implementing cooling water changes. Plant staff can implement necessary changes this spring. Equipment/Building Issues 10. Centrifuge repair is in progress and should be completed by February. This equipment is needed for back-up not regular operation. 11. The Maintenance Building roof is to be scheduled for repair as soon as the weather permits, but no later than April. 12. Vehicle replacements will include choices for budgeting. As fiscal constraints allow, new or used vehicles will be provided and the appropriate cost charged to the Sewer Fund. 13. The large trailer-mounted generator is needed for backup power at certain pump stations. While it would be nice to replace this cumbersome piece of equipment with a more versatile unit, it is not a high priority item for budget consideration at this time. 14. Portable computers were required for Engineering and the WQC~. Engineering received the computer from the plant rehab project and WQCP staff purchased a new computer which was included in the 93-94 operating budget. A third computer that is compatible with necessary software will be provided for the new Source Control Inspector. Operational Issues 15. TiLlo compost pile is a growing problem. The new Solid Waster Coordinator position will be responsible for evaluating options and expanding the marketing of this product. 16. The Laboratory Supervisor will take samples and analyze the Price Club sludge/debris to determine the content and establish proper standards for handling. 17. Improvements are required for polymer storage, most likely new building space is needed. This project will be coordinated in the CIP and if possible combined with the currently programmed general storage building. 18. The Bisulfite system is a known spill risk. The Maintenance Supervisor is to review the extent and impact of a possible spill with appropriate personnel from County Health Department. The findings/recommendations are to be conveyed to management. The Bisulfite system is included in the Plant Distribution System Project (evaluation phase in progress) and is scheduled to be replaced within a couple of years. 19. In the course of completing the recent WQCP renovation, one of the four digesters was found to be structurally deficient. It has been taken out of routine service, but is available for interim, stand-by use. The result is that daily plant operations are made more difficult which is evident by the increased foaming experienced. The digester's required rehabilitation has been noted in the 5 year CIP, but it has not been funded to date. The City Council has been advised that the digester rehab will be included as programmed in the next CIP update (FY 94-95). Follow-Up In order to track the progress being made on each of the above items, Eepartment Management agrees to conduct a joint review with representatives of Unit D in six months to assess the effectiveness of these measures.
