HomeMy WebLinkAboutReso 51-1993 RESOLUTION NO. 51-93 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING THE SECOND AMENDMENT TO AGREEMENT FOR AIRCRAFT NOISE MITIGATION WHEREAS, the City of South San Francisco ("City") and City and County of San Francisco ("Airport") entered into an Agreement for Aircraft Noise Mitigation on August 29, 1991; and WHEREAS, the City has determined that extensive planning and environnental evaluations are required to be performed prior to considering the actions set forth in the Agreement; and WHEREAS, the city will not be able to complete the above- stated evaluations within the time frame set forth in the August 29th Agreement; and WHEREAS, additional time is required to complete the subject evaluatLons; and WHEREAS, the City and Airport have agreed that the costs incurred in preparing the necessary documentation to effectuate the Agreement should be chargeable against the proceeds of the Agreement; and WHEREAS, the Second Amendment to the Agreement for Aircraft Noise Mitigation provides a further extension of time to April 1994 in order to fulfill the terms previously described, which date coincides with the expiration of the moratorium currently in effect; and WHEREAS, the Second Amendment provides for disbursement of funds to the City on a percentage basis (25%) upon execution of this Amendment, on June 1, 1993, September 1, 1993 and upon certification of the EIR. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco does hereby resolve as follows: 1. The "Second Amendment To Agreement For Aircraft Noise MitigatLon" attached hereto as Exhibit "A" is hereby approved. 2. The City Manager is hereby authorized to execute the subject Amendment and any related documents necessary to accomplish its purpose. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the city of South San Francisco at a regular meeting held on the 28th day of April , 1993 by the following vote. AYES: Councilmembers Jack Drago, John R. Penna, Robert Yee, and Mayor Roberta Cerri Teglia NOES: None ABSTAIN: None ABSENT: Councilmember Joseph A. Fernekes Aircraft. Amd
