CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SOUTH SAN FRANCISCO ADOPTING THE
ANNEXATION TAX-SHARING AGREEMENT WITH SAN
MATEO COUNTY WITH REGARDS TO THE MCLELLAN
NURSERY PROPERTY
~EREAS, the City is considering adoption of a
redevelopment plan ("Redevelopment Plan") for the E1 Camino
Corridor Area Project Area which includes the McLellan Nursery
site which is currently an unincorporated area; and
~4EREAS, the city is contemplating annexation of the
McLellan Nursery site into the City of South San Francisco if
the Redevelopment Plan is adopted; and
~EREAS, the Redevelopment Agency of the City of South San
Francisco ("Agency") has agreed to enter into an agreement with
the County of San Mateo ("County") which mitigates the
financial burden or detriment suffered by the County as a
result of adoption of the Redevelopment Plan ("Fiscal
Agreement"); and
~EREAS, a condition to the Fiscal Agreement is the
agreement by the city and the County upon a tax sharing
agreement with regards to the McLellan Nursery site in the
event of annexation; and
~EREAS, the City and the County desire to enter into an
Annexation Agreement ("Agreement"), the terms of which are set
forth in the Agreement attached hereto as Exhibit "A" and by
this reference incorporated herein, to determine the property
tax allocation in the event of annexation of the McLellan
Nursery site.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of South Francisco hereby approves the Agreement in
substantially the form attached hereto as Exhibit "A" with any
further modifications as deemed appropriate by the City
Manager, and authorizes and directs the City Manager to execute
the Agreement on behalf of the City.
I hereby certify that the foregoing Resolution was
regularly introduced and adopted by the City Council of the
City of South San Francisco at regular meeting held on
the 26th day of May , 1993 by the following vote:

BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA
A RESOLUTION OF THE COUNTY OF SAN MATEO MAKING
DETERMINATION OF PROPERTY TAX EXCHANGE PURSUANT
TO THE PROVISIONS OF CHAPTER 282, SECTION 59,
PART 0.5, IMPLEMENTATION WITH ARTICLE XIIIA OF THE
CALIFORNIA CONSTITUTION, COMMENCING WITH SECTION 95,
DIVISION 1, OF THE REVENUE AND TAXATION CODE AND
AGREEMENT WITH THE CITY OF SOUTH SAN FRANCISCO
RESOLVED, by the Board of Supervisors of the County of San
Mateo, California, that:
WHEREAS, state law requires that the County of San Mateo and
the City of South San Francisco agree to a property tax exchange as
a result of the proposed annexation of the McLellan Properties to
the City of South San Francisco; and
WHEREAS, the subject determination has been made prior to and
as a condition precedent to the Executive Officer of the Local
Agency Formation Commission issuing the Certificate of Filing on
said proposal; and
WHEREAS, this agreement will be in effect only if the E1
Camino Corridor Redevelopment Project is adopted and carried out;
and
WHEREAS, the County of San Mateo in making this determination
has reviewed the proposed property tax exchange and the amount of
said exchange; and
WHEREAS, it has been agreed that there will be no exchange of
property tax between the City of South San Francisco and the County
of San Mateo at the time of annexation of the affected properties;
and
WHEREAS, it has been agreed that an agreement will be
submitted upon termination of the E1 Camino Corridor Redevelopment
Project and that at that time the property tax revenue produced by
an incremental factor of .0528140890 for the affected properties
will be transferred between the County of San Mateo and the City of
South San Francisco; and
WHEREAS, it has been agreed that property tax revenue produced
by an incremental factor of .0745059190 for the affected properties
will be transferred between the County of San Mateo Fire Protection
District (Tax Rate Area 81-003) and the City of South San
Francisco; and
WHEREAS, it has been agreed that property tax revenue produced
by an incremental factor of .0398309920 for the affected properties
will be transferred between the County of San Mateo Free Library
Tax (Tax Rate Area 81-003) and the City of South San Francisco.
NOW, THEREFORE, the County of San Mateo does hereby resolve,
determine and order as follows:
1) The property tax incremental factor to be transferred
from the County of San Mateo to the City of South San Francisco is
zero at this time and a subsequent property tax exchange agreement
upon termination of the E1 Camino Corridor Redevelopment Project
between the County of San Mateo and the City of South San Francisco
will exchange property tax revenue resulting from an increment of
.0528140890.
2) The property tax incremental factor to be transferred
from the San Mateo County Fire Protection District (Tax Rate Area
81-001) ~o the City of South San Francisco is .0740549190.
3) The property tax incremental factor to be transferred
from the County of San Mateo Free Library (Tax Rate Area 81-001) to
the City of South San Francisco is .0398309920.
4) In accordance with Section 3a of Article XIIIB of the
State Constitution, the appropriation limit of the City of South
San Francisco shall be increased by amounts indicated above, and
the appropriation limits of the San Mateo County Fire Protection
District and County Library shall be decreased by the same amount.
The exchange of said revenues is approved conditioned upon the
adoption of the E1 Camino Corridor Redevelopment Project and the
completion of the proposed annexation of the McLellan Properties to
the City of South San Francisco and is effective immediately upon
completion of the annexation.
