HomeMy WebLinkAboutReso 103-1992RESOLUTION NO. 103-92 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO OF INTENTION TO MAKE CHANGES AND MODIFICATIONS WITH RESPECT TO GATEWAY ASSESSMENT DISTRICT NO. ST-82-2 RESOLVED, by the City Council (the "Council") of the City of South San Francisco (the "City"), County of San Mateo, State of California, that: WHEREAS, this Council has hereto conducted special assessment proceedings (the "Proceedings") in and for its Gateway Assessment District No. ST-82-2 (the "District") pursuant to Resolution of Intention No. 74-82 adopted July 7, 1992 (the "Resolution of Intention") under the provisions of the Municipal Improvement Act of 1913, being Division 12 of the California Streets and Highways Code (the "Act"), and reference to such Proceedings, including refunding and reassessment proceedings therein had is hereby made for further particulars; and WHEREAS, in the Proceedings, the City Council has authorized and issued certain special assessment bonds, a portion of the proceeds of which remain in the improvement funds therefor and upon which proceeds no further claims or uses remain for the works of improvement heretofore specified in the Proceedings; and WHEREAS, there exists certain additional works of improvement for which said remaining proceeds may be used and said works are generally described in Exhibit "A" attached hereto and hereby made a part hereof; WHEREAS, pursuant to Chapter 4.5 of the Act, this Council intends to make certain changes and modifications in the Proceedings to incorporate said additional works of improvement within the Proceedings and to expend the proceeds remaining in the improvement funds to acquire and/or construct said works of improvement; and WHEREAS, by virtue of said intended changes and modifications, this Council preliminarily determines that neither total amount of assessment heretofore levied in the Proceedings, nor any individual assessment is increased and benefits to be derived from said additional works of improvement shall not affect the distribution of benefits derived by the lands within the District; and WHEREAS, their is on file with the City Clerk of the City a Petition and Request from certain of the owners of land within the District specifically requesting the making of said changes and modifications. NOW, THEREFORE, IT IS ORDERED as follows: 1. The foregoing recitals are all true and correct. 2. It is hereby determined that the public interest, convenience and necessity will be served by the making of the changes and modifications to the Proceedings as set forth in Exhibit "A". 3. Notice is hereby given that Wednesday, September 9, 1992 at the ~.our of 7:30 o'clock p.m. in the regular meeting place of this Co'ancil, Municipal Services Building, Community Room, 33 Arroyo Drive, South San Francisco, California, be and hereby are appointed as the date, hour and place when and where this Council will conduct a public hearing upon and finally consider whether the public interest, convenience and necessity require the changes and modifications as set forth in Exhibit "A" hereto. 4. Notice is further given that at the time and place of the hearing set forth above, any interested person having any objection to the proposed changes and modifications may appear before the Council and show cause why the changes should not be ordered. Written objections to the proposed changes and modifications may be filed wSth the City Clerk not later than the time set for the hearing. 5. Notice is further given that Jes6s Armas, City Manager of the City, City Hall, 400 Grand Avenue, South San Francisco, California 94080, telephone (415) 877-8500, is hereby designated as the person to answer questions about the above scheduled hearing. 6.
