HomeMy WebLinkAboutReso 146-1992RESOLUTION NO. 146-92 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO CONCURRING WITH THE TOLLING OF 832 DAYS FOR LITIGATION WHICH RESULTS IN EXTENDING THE TERRABAY SPECIFIC PLAN AND DEVELOPMENT AGREEMENT TO MARCH 14, 1995 WHEREAS, the Terrabay Specific Plan provides for extension by operation of law; and WHEREAS, on April 28, 1983 a petition was filed in the case of Pollard vs. the city of South San Francisco, et al. and ended on August 7, 1985 with a decision rendered in that case, representing a tolling period of 832 days; and WHEREAS, the City Council has received all material presented, has considered all evidence presented, and concurs with the recommendations continued in the Staff Report on October 27, 1992; and WHEREAS, the extension of the Terrabay Specific Plan and Development Agreement are consistent with the goals, policies and objectives of the General Plan. FOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco concurs with W.W. Dean & Compar.y that the Terrabay Specific Plan and Development Agreement have been tolled by operation of law for 832 days until March 14, 1995. I hereby certify that the foregoing Resolution was regularly introduced and adopted by ~he City Council of the City of South San Francisco at a re§u/ar meeting held on the 28th day of 0ct0ber , 1992 by the following vote: AYES: Councilmembers Jack Drago, Joseph A.
