CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION ADOPTING A NEW SECTION 125 FLEXIBLE
BENEFITS PLAN AND PLAN ADMINISTRATOR AND
AUTHORIZING CITY STAFF TO ADMINISTER PLAN
WHEREAS, the City of South San Francisco ("City")offers benefit plans for its employees,
one of which is the Section 125 Flexible Benefit Plan ("Plan"), which provide City employees with
the opportunity to designate pre-tax payment of insurance premiums and contributions to spending
accounts that are excludable from gross income; and
WHEREAS, City staff recommends changing its provider for the administration of the Plan,
effective January 1, 2011; and
WHEREAS, changing Plan providers requires the City to adopt new Plan documents,
including a Plan Adoption Agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San
Francisco that the City of South San Francisco hereby adopts the Plan in the form attached hereto,
which Plan is hereby adopted and approved; and
BE IT FURTHER RESOLVED by the City Council of the City of South San Francisco that
the Human Resources Director of the City of South San Francisco and/or his/her delegates, be, and
they hereby are, authorized and directed to execute the Plan on behalf of the City; and
BE IT FURTHER RESOLVED by the City Council of the City of South San Francisco that
said officers of the City of South San Francisco be, and they hereby are, authorized and directed to
take any and all actions and execute and deliver such documents as they may deem necessary,
appropriate or convenient to effect the foregoing resolutions including, without limitation, causing to
be prepared and filed such reports, documents or other information as may be required under
applicable law.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by the
City Council of the City of South San Francisco at a regular meeting held on the 8t" day of December
2010 by the following vote:
AYES: Councilmembers Mark Addiego, Pedro Gonzalez, and Karyl Matsumoto,
Vice Mayor Richard A. Garbarino and Mayor Kevin Mullin
NOES: None
ABSTAIN: None
ABSENT: None
