HomeMy WebLinkAboutReso 107-1991RESOLUTION NO. 107-91 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING A REWARD FOR INFORMATION AND APPREHENSION OF RESPONSIBLE PERSONS IN THE CELESTINO GUZMAN DIAZ HOMICIDE CASE WHEREAS, Section 53069.5 of the Government Code of the State of California authorizes the South San Francisco City Council to offer a reward for information resulting in the apprehension of any responsible person whose willful. ~isconduct results in the death of any person; and WHEREAS, Celestino Guzman Diaz was killed by an unknown assailant on or about April 13, 1991; and WHEREAS, this action to authorize a reward is taken for the immediate protection of the public peace, health, and safety so as to apprehend the person responsible and remove a menace to local rights; and WHEREAS, the need for protection from such responsible person is peculiarly local and municipal to this city. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. A reward is hereby offered in the amount of Five Thousand Dollars ($5,000) for the receipt of information resulting in the apprehension of the person or persons responsible for the death of Celestino Guzman Diaz. 2. The reward is limited to the amount set forth in this resolution and payment is conditional upon the being of a type and nature that would lead to apprehension of the person or persons responsible for such death. Any individual claiming the reward must, within ten (10) days of furnishing the information, complete and file with the Police Department a "claim for reward". Such claim form shall be provided by the Police Department and shall be approved by the City Attorney. 3. T~e determination as to whether an individual is qualified to receive a reward and the amount and the individuals who shall receive such a reward or portion t~ereof, shall be subject to the sole discretion and approval of the City Manager upon recommendation of the Chief of Police. The decision of the City Manager shall be final and without appeal to the City Council. I hereby certify that the foregoing Resolution was regularly introduced and adopted ky the City Council of the City of South San Francisco at a regular meeting held on the 14th day of August , 1991 by the following vote: AYES: NOES; ABSTAIN: ABSENT: councilmembers Richard A. Haffey, Gus Nicolopulos, John R. Penna, Roberta Cerri Teglia, and Mayor Jack Drago None None None 2
