HomeMy WebLinkAboutReso 73-1992RESOLUTION NO . 73-92 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTI©N TERMINATING THE FRANCHISE AGREEMENT WITH BENCH AD COMPANY AND DIRECTING THE REMOVAL OF ALL THE COMPANY'S BENCHES FROM THE PUBLIC RIGHT-OF-WAY WHEREAS, the City entered into a franchise agreement with Western Advertising Systems in 1954 and the franchise is currently owned by the Bench Ad Company; and WHEREAS, the benches were placed to serve the routes of the Northgate Transit System, which is no longer in existence; and WHEREAS, the City's financial return from the franchise agreemen~ is minimal; and WHEREAS, in August of 1991 the City Council opposed the advertising in SamTrans bus shelters; and WHEREAS, South San Francisco Municipal Code §§ 20.76.100(g) and (i) prohibit signs on public property and off-premises signs. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South Francisco that a "Notice of Intention Not To Renew" be delivered to the Bench Ad Company and that the franchise agreement dated September 2, 1954 be terminated. BE IT FURTHER RESOLVED that the company be notified to remove the benches and make any and all necessary repairs to the City sidewalks as a result of their removal, subject to the approval of the Public Works Director at no cost to the City. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 8th day of ~u]y , 1991 by the following vote: AYES-.
