HomeMy WebLinkAboutReso 34-1991RESOLUTION NO. 34-91 CIITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF THE CITY COUNCIL OF SOUTH SAN FRANCISCO ADOPTING LOAN PROGRAM FOR ENGINEERING ANALYSIS OF UNREINFORCED MASONRY IURM) BUILDINGS WHEREAS, in 1986 the state legislature adopted Government Code 8875 et seq, which establishes a program within all cities to identify all potentially hazardousibuildings subject to seismic action and to establish a program for mitigation of identified potentially hazardous buildings; and WHEREAS, Government Code Section 8875.2(b) provides in part that the mitigation program of a city may include adoption by ordinance of a hazardous buildingslprogram, measures to strengthen buildings, and other incentives to repair buildings available from local programs; and WHEREAS, this City Council has initiated the state program by identifying potentially hazardous buildings and adopting Chapter 15.28 of the South San Francisco Municipal Code which establishes a program to require unreinforced masonry URM building owners, upon service of an order, to cause a structural analysis so be made of a URM identified building by an engineer or architect licensed by the state, and to submit the report to the Chief Building Inspectoriby February 28, 1992; and WHEREAS, this City Council has entered into a program to select an approved engineering firm to complete the required analysis of the two city-owned URM buildings!and to provide engineering analysis for other URM building owners who wish ~o voluntarily participate in the joint analysis with the selected and approved engineer; and WHEREAS, on February 17, 1991 the City Council approved EQE Engineering as the firm lo complete the required engineering analysis for the city and on behalf oflURM building owners who volunteer to participate in the joint analysis for which EQE Engineering has provided a schedule of fees for analysis Costs for each URM building identified; and WHEREAS, it is deemed to be in the best interests of the city and its citizens ~o maintain the existence and integrity of URM buildings, especially within the older downtown area, and to financially assist URM building owners in the engineering analysis program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco~ California, as follows: 1. Ailoan program is hereby established for the use and benefit of owners of recordi of URM buildings identified in Exhibit "A" attached hereto, who are in financial need as determined upon an analysis by City staff of a loan applicant!'s financial resources and/or whose household income meets low or moderate ~ncome standards. 2. Upon written application for a loan from the city through the Director of Economic and Community Development, upon terms and conditions established, loans areihereby authorized and directed to be provided such building owner applicanti from city funds for a sum not to exceed the total cost amount set forth forleach respective building address in Exhibit "A" attached hereto. 3. The terms and conditions of such loan shall be that the loan shall not exceed a ~erm of three years from the time of execution of a promissory note secured by a deed of trust upon the building property for which the loan shall benefit, i 4. The principal loan amount shall bear interest at one (1%) percent per annum. 5. The promissory note evidencing the loan shall provide for no prepayment penalty and shall provide for a late payment penalty on the amount due as ofithe maturity date. 6. The building owner applicant shall provide with the written loan application a title company report setting forth ownership in the property and encumbrances of record. 7. Ail escrow costs, recording and other fees which may be incurred in the process of the loan shall be borne by the building owner applicant. 8. URM building owners shall apply for a loan and respond in writing as to whether or not participation shall be with EQE Engineering or some other personally selected engineering or architectural firm on or before May 31, 1991.
