HomeMy WebLinkAboutReso 97-1990 RESOLUTION NO. 97-90 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ADOPTING A RISK MANAGEMENT POLICY WHEREAS, the City of South San Francisco is a member of the Association of Bay Area ~overnments Pooled Liability Assurance Network (ABAG PLAN); and WHEREAS, the City is committed to protection and conservation of persons and prope-ty from injury or destruction; and WHEREAS, the systematic identification and control of unnecessary risks, undertakings or hazardous conditions minimizes the City's physical and financial losses as well as human sufferings; and WHEREAS, it is the intent of the City Council to provide a safe environment for its residents, visitors, and employees in which to live and work; and WHEREAS, risk management is a concept designed to protect and conserve municipal assets and to foster a safe environment. NOW, T~EREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco hereby recognizes risk management activities as an integral part of the City's overall management system and adopts a risk management program to prese~e its human, physical, and financial resources. Haffey None None None City Clerk RESOLUTION NO. 97-90 CITY OF SOUTH SAN FRANCISCO RISK MANAGEMENT PROGRAM Program G~als The majorlgoals of the risk management program are: 1. To eliminate or reduce the "risk of loss" which is defined as the organization's vulnerability to accidental or unintended loss. 2. To apply responsive claims management techniques to losses that do occur. 3. To protect the City budget from catastrophic losses, or an annual accumulation of losses, that would cause financial hardship. Catastrophic loss is defined as any loss in excess of $1,000,000. 4. To see< restitution and recover costs when legally appropriate. Program P~licies 1. The risk management program involves a systematic process to identify, measure and control loss exposures. Losses include all forces which could jeopardize the City, such as circumstances which damage reputation, as well as claims exposures. A citywide hazard identification system will be implemented by the Risk Manager to quickly identify hazardous conditions and effect repairs. All employees shall be encouraged to notify their supervisor, department head, or the Risk Manager of any condition that may expose someone to injury or damage. As appropriate, money and time will be allocated to take preventive measures and make necessary repairs. 2. The risk management program involves a responsive claims administration system. As a member of the Association of Bay Area Governments Pooled Liability Assurance Network (ABAG PLAN), the City works with ABAG PLAN on claim adjustment. The Risk Manager will review all incident reports and claims, and will notify ABAG PLAN in a timely manner of all serious accidents or claims. Department heads and supervisors will review all accideqt reports, incident reports, and claims affecting their organization, and provide timely information to the Risk Manager and ABAG PLAN's adjusters. 3. The risk management program involves the transfer of the City's risk of loss to others whenever possible and practical. The Risk Manager will develop a risk transfer process that assures the use of hold harmless and indemnity clauses in all agreements in which the City is a party, and the use of insurance clauses that provide adequate protection to the City. 4. The risk management program involves the City seeking restitution and recovering costs whenever it is legally appropriate to do so. The Risk Manager will coordinate restitution efforts, such as billing for agency emergency response costs, seeking recovery for injuries suffered by safety personnel, and invoicing for non-meritorious claims. Accident ~eview Process An accident review process shall be used to review all accidents, incidents and claims involving City vehicles and employees on duty to determine their cause, preventability, methods to prevent similar future occurrences, and claims and litigation defense strategy. Safety Review Process A safety ~eview process shall be used to review all employee injuries, and discuss safety issues and get feedback from employees on how to make City operations safer. The safety review process shall take into account standard industrial safety practices and safety orders issued by state agencies. The Central Safety Committee reviews and the department reviews of employee injuries and a comprehensive yearly safety inspection are important components of this p~ocess. Insurance The City ~as established and will periodically review its retention limits consistent with its financial resources. The City will maintain reserves on all self-insured losses to recognize the expected future cost, and appropriate funds to cover all self-insured liabilities. Insurance for risks and catastrophic loss potential shall be purchased whenever it is economically feasible, within the judgment of the City Manager. Risk Management Responsibilities Risk management is an inherent part of general management. Overall responsibility for the risk management program shall lie with the City Manager. The risk management program shall be directed by the City's Risk Manager. Risk awareness shall be the responsibility of each employee and each department and division head is accountable for leadership on risk awareness and prevention matters. The Risk ~anager shall be the City's liaison with ABAG PLAN and its claim administration program. The City Council delegates, in accord with Government Code Section 935.4, the functions of the local government entity with regard to acceptance, rejection, or compromise of claims to the Risk Manager.
