HomeMy WebLinkAboutReso 144-1988CITY RESOLUTION NO. 144-88 )UNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS WITHOUT FURTHER ACTION UNDER THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 FOR THE EL CAMINO PLAZA ASSESSMENT DISTRICT WHEREAS, a written petition for undertaking proceedings pursuant ito special assessment and assessment bond acts, and to assess the cost thereof upon the properties benefited, and waiving proceedings under Division 4 of the Streets and Highways Code, (Section 2800 et. seq.) signed by the owners of more than 60% in area of the properties proposed to be assessed, has been filed with the City Clerk for the making of the acquisitions and improvements described on Exhibit "A" attached and incorporated; and WHEREAS, the costs and expenses of the acquisitions and improvements are to be chargeable upon an assessment district, the exterior boundaries of which are the coterminous exterior boundarie[s of the composite and consolidated area shown on the map thereof On file in the office of the Clerk, to which reference is hereby ma~e for further particulars; and WHEREAS, the public interest and convenience will be served by the taking of proceedings; NOW,! THEREFORE, BE IT RESOLVED by the City Council of the City of Sbuth San Francisco as follows: 1. That all of the owners of more than 60% in area of the property subject to assessment for the acquisitions and improvements who appear to be such on the Assessor's roll on the day that the petition was filed, or, in the case of transfers of land or parts thereof subsequent to the date upon which the last Assessor's roll was prepared, appear to be such on the records in the County Assessor's office which the County Assessor will use to. prepare ~he next ensuing Assessor's roll, have signed and filed with thei Clerk a written petition for the acquisitions and improvements and a written waiver of investigation proceedings under Division 4 of the Streets and Highways Code. 2. i That the provisions of Division 4 of the Streets and Highways iCode, other than those which relate to the foregoing findings,i determinations and orders, shall not apply to the making of the ~cquisitions and improvements, and proceedings therefor shall be had pursuant to the Municipal Improvement Act of 1913 and bonds shall be issued pursuant to the Improvement Bond Act of 1915, without further proceedings under Division 4. Haffay, Gus NicoloPulo-~, and Maynr Rnhmrta £~rri T~glia None None None -2- EXHIBIT A TO RESOLUTION NO. 144-88 CITY OF SOUTH SAN FRANCISCO E1 Camino Plaza Assessment District DESCRIPTION OF WORK Thei construction of a twelve inch water line (fire main) along the eastern side of E1 Camino Real including valves, hydrants, and appurtenances, for a total distance of approximately 1,100 feet and commencing at the northern boundary of the lands of Kaiser Hospital and extending northerly along E1 Camino Real to the common boundary of the lands of Pacific Gas & Electric Company and McClellan. Thei remainder of the acquisitions and improvements of this districti shall consist of the construction of storm drainage improvements to Colma Creek and the construction of a sanitary sewer ma~n to be located generally on the western side of Colma Creek, the exact extent and location of which improvements shall be determined pursuant to the recommendations of the Health Officer and the Department of Public Works of the City of South San Francisco. Alll of the foregoing shall include the acquisition of all rights oil way, easements, licenses, franchises and permits, and the completion of all auxiliary work necessary and/or convenient for the accomplishment of the foregoing.
