CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION CALLING FOR SEALED PROPOSALS AND FIXING LIQUIDATED
DAMAGES FOR FAILURE TO COMPLETE THE WORK WITHIN TIME SPECIFIED
FOR THE EL CAMINO PLAZA ASSESSMENT DISTRICT
W~EREAS, on December 14, 1988, this Council adopted
Resolution No. 145-88, A Resolution of Intention to Make
Acquisitions and Improvements, and plans and specifications
suitable for calling for bids for construction of the public
improvements described in that resolution have been submitted for
approval by this Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of South San Francisco as follows:
1. That the plans and specifications for the construction
of the improvements, on file in the office of the City Clerk of
the City, are hereby approved.
2. The City Clerk is hereby directed to cause to be
published once a week for two weeks in the Enterprise Journal, a
newspaper published and circulated in the City of South San
Francisco, a notice inviting sealed proposals or bids for the
construction of the improvements, and referring to the plans and
specifications on file in the office of the City Clerk, the first
publication of which notice shall be at least fourteen (14) days
prior to the time fixed for opening bids.
3. Ail proposals or bids shall be accompanied by cash, a
cashier's or certified check payable to the order of the City of
South San Francisco amounting to ten percent (10%) of the bid, or
by a bond in that amount and payable to the City of South San
Francisco signed by the bidder and a corporate surety or by the
bidder and two sureties who shall justify before any officer
competent to administer an oath, in double that amount and over
and above all statutory exemptions. The amount so posted shall
be forfeited to this City in case the bidder depositing the same
does not, within fifteen (15) days after written notice that the
contract has been awarded to such bidder, enter into the contract
to construct the improvements.
4. Pursuant to Section 1773 of the Labor Code of the State
of California, the City of South San Francisco has obtained from
the Director of the Department of Industrial Relations the
general prevailing rate of per diem wages and the general
prevailing rate for holidays and overtime work for each craft,
classification, or type of workman required to execute the
contract. A copy of that prevailing rate of per diem wages is on
file in the principal office of the City of South San Francisco,
to which reference is hereby made for further particulars. The
prevailing rate of per diem wages will be made available to any
interested party upon request, and a copy thereof shall be posted
at the job site.
5. That in the event the contractor does not complete the
work within the time limit specified in the proposed contract or
within such further time as this Council shall have authorized,
the contractor shall pay to this City liquidated damages in the
amount of Five Hundred Dollars ($500.00) per calendar day for
each and every day's delay in finishing the work beyond the
completion date specified in the contract. Additional provisions
with regard to the time of completion and liquidated damages are
set forth in the specifications, which provisions are hereby
referred to and incorporated herein by this reference.
6. The sealed proposals or bids shall be delivered to the
City Clerk of the City, at 400 Grand Avenue, South San Francisco,
California 94080, at or before the hour of 2:00 o'clock p.m. on
March 28, 1989, the time being not less than fourteen (14) days
from the time of the first publication of the notice as provided
above. Bids will be publicly opened, examined and declared on
the day and hour, and referred to and considered by this Council
at its meeting Wednesday, May 10, 1989, at or after the hour of
7:30 o'clock p.m.
