HomeMy WebLinkAboutReso 64-1989 RESOLUTION NO. 64-89 CITY!COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING A RESIDENTIAL ANTIDISPLACEMENT AND RELOCATION ASSISTANCE PLAN WHEREAS, Section 509 of the Housing and Community Development Act of 1987 requires ~hat recipients of Community Development Block Grant (CDBG) funds after September 30, 1988 have a "residential antidisplacement and relocation assistance plan"; and WHEREAS, the City must include a certification with its application for 1989-90 CDBG that it is following such a plan; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francilsco that it hereby approves the "Residential Antidisplacement and Relocation Assistance Plan", Exhibit "A" attached, and authorizes the City Manager to make the Plan available to the public, in accordance with Department of Housing and Urban Development Regulation. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the lOth day of May , 1989, by the following vote: AYES: City Councilmembers Mark N. Haffey, Gus Nicolopulos, and Mayor Roberta Cerri Teglia NOES: None ABSTAIN: None ABSENT: None EXHIBIT "A" TO RESOLUTION NO. 64-89 CITY OF SOUTH SAN FRANCISCO RESIDENTIAL ANTIDISPLACEMENT AND RELOCATION ASSISTANCE PLAN UNDER SECTION 104 (d) OF THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AS AMENDED It is the intent of the City of South San Francisco to avoid, to the greatest extent feasible, the displacement of any persons from their homes as a result of activities assisted with funds provided under the Housing and Community Development Act of 1974, as amemded. This effort to minimize displacement will be carried out byldesigning activities in such a way that displacement is avoided, except in extraordinary circumstances in which no feasible alternatives to displacement are available if the City's community development objectives are to be met. Should displacement become necessary under such circumstances, relocation benefits will be provided in accordance with applicable Federal law. In accordance with Federal requirements, the City of South San Francisco will replace all occupied and vacant occupiable low/moderate-income dwelling units demolished or converted to a use other than as low/moderate-income housing as a direct result of activities assisted with funds provided under the Housing and Community Development Act of 1974, as amended, as described in 24 CFH 570.606(b)(1). All replacement housing will be provided within three years of the commencement of the demolition or rehabilitation relating to conversion. Before obligating or expending funds that will directly result in such demolition or conversion, the City will make public and submit to the HUD Field Office the following information in writing: 1. A description of the proposed assisted activity; The general location on a map and approximate number of dwelling units by size (number of bedrooms) that will be demolished or converted to a use other than as low/moderate- income dwelling units as a direct result of the assisted activity; A time schedule for the commencement and completion of the demolition or conversion; The general location on a map and approximate number of dwelling units by size (number of bedrooms) that will be provided as replacement dwelling units; The source of funding and a time schedule for the provision of replacement dwelling units; and The basis for concluding that each replacement dwelling unit will remain a low/moderate-income dwelling unit for at least l0 years from the date of initial occupancy. The City will provide relocation assistance, as described in 570.606(b)(2), to each low/moderate-income household displaced by the demolition of housing or by the conversion of a low/moderate- income dwelling to another use as a direct result of assisted activities. Consistent with the goals and objectives of activities assisted under the Housing and Community Development Act of 1974, the City will minimize the displacement of persons from their homes by avoiding, to the greatest extent possible, the utilization of funds provided under the Act for the following types of activities: Activities involving the demolition of housing units or the conversion of low and moderate-income housing to housing for higher-income persons· Rehabilitation of housing units which would require the permanent displacement of the occupants, including changes in the size or bedroom composition of units. Rehabilitation of housing units which would result in increased rents to the extent that low and moderate-income tenants would have to pay in excess of 30 percent of their income for rent. 9:ANTIDISP.PLN
