HomeMy WebLinkAboutReso 76-1989 RESOLUTION NO. 76-89 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION DECLARING THE ON-PREMISES ADVERTISING DISPLAY AT 1045 AIRPORT BOULEVARD TO BE ILLEGAL AND CALLING FOR ITS ABATEMENT AS A PUBLIC NUISANCE WHEREAS, Chapter 2.6, Division 3 of the California Business & Professions Code (Sectdon 5499.1 et seq.) authorizes the City to abate as public nuisances all illegal on-premises advertising displays; and WHEREAS, Section 5499.1 of the Business & Professions Code includes in the definition of illegal advertising display any sign which has not been used to identify or advertise an ongoing business for a period of not less than ninety (90) days; and WHEREAS, there exists a sign structure at 1045 Airport Boulevard (A.P.N. 01~-095-180) which for a period of over ninety (90) days has not been used ~o identify or advertise the business being conducted at that address. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco ~hat: 1) The on-premises advertising display located at 1045 Airport Boulevard in South san Francisco is illegal as defined by state law. 2) The sign is hereby declared a public nuisance and shall be abated. BE IT FURTHER RESOLVED that the City Council will hold a hearing on July 12, 1989 at which time the Council shall hear and consider all objections to the proposed removal of the sign. The alleged illegality qnvolves the non-use of the sign structure for a period in ~xcess of ninety (90) days. If the Council determines that the sign is illegal it may declare the sign a public nuisance and order it abated. This will not be a public hearing. However, if the Council does determine that the sign should be abated, a second hearing must be held in which you would be allowed to raise any objections you might have.
