HomeMy WebLinkAboutReso 70-1988CITY RESOLUTION NO. 70-88 , CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ADOPTING REGULATIONS GOVERNING USE AND A FEE CHART FOR THE WESTBOROUGH PARK BUILDING WHEREAS, ;he City's Westborough Park Building is scheduled to open for public use on July 1988; and WHEREAS, the Westborough Park Building contains facilities appropriate for use by both community groups and private businesses; and WHEREAS, it is necessary to have regulations regarding the use of these facilitie~ and a fee chart for rental of the facilities, NOW, -HEREFORE, BE IT RESOLVED by the City Council of the City of South San Franc"sco that the regulations governing use and the fee chart for the Westborough Park Building, attached as Exhibit "A" are hereby adopted. Haffey, Gus NOES: ABSTAIN: ABSENT: Nicolopulos, Roberta Cerri Teglia, and Jack Drago None None None EXHIBIT A TO RESOLUTION NO. 70-88 REGULATIONS GOVERNING USE OF THE CITY OF SOUTH SAN FRANCISCO WESTBOROUGR PARK RECREATION CENTER Westborough Park Recreation Center is available on a rental basks to: 1) local Community-based groups and organizations andI 2) private use to individuals, groups, organizations and businesses. Commercial use by private groups for the purpose of sales, promoting or negotiating for sales for profit is not permitted· Approval of use and status of ren~ing group to be determined by City officials· Anyl individual, group, organization or business using the Westborough Park Recreation Center property shall agree to indemnify and hold the City of South San Francisco and all of its officers, agents, employees or officials harmless from and against any and ail liability for any accident or injury or any claim of damages which may be suffered by any individual(s) arising out of or in any way connected with his use or occupancy of this facility without regard to the active negligence of the City of South San Francisco or its officers, agents, employees or officials. Individuals, groups, organizations or businesses using the Westborough Park Recreation Center shall be required to furnish satisfactory written evidence of liability insurance coverage in the amount of $500,000, a minimum of one (1) month prior to the event. Reservations may be made up to one (1) year in advance of use. All reservations must be applied for in writing a minimum of one (1) month in advance of use at the Recreation and. Community Services offices. Reservations must be accompanied by $100.00 non-refundable deposit to hold a requested date. Remaining charges are to be paid in full a minimum of one (1) month in advance of use. Checks shall be made payable to the South San Francisco Recreation and Community Services. Reservations and deposits are not transferrable. All'i events must conclude by 1:30 am. No overnight storage is ~vailable. Cancellation may occur and be necessary on either the rennees or renters part due to any unnatural act or disaster beyond human control. Payment will be refunded in said insnances. No public meeting or entertainment held in the Westborough ParK Recreation Center will be permitted that reflects in anylway upon, or discriminates against, citizens of the United States because of their sex, race, creed or color. 8. Juvenile groups and organizations must have adult sponsorship and supervision. There must be one (1) adult supervisor (age 21) for each fifteen (15) juveniles. Laws regarding the use of alcoholic beverages will be strictly enforced. 9. Buiilding security personnel, City staff or representative wil!l be in charge of the building during the entire time tha~ it is open. No entries shall be allowed into the Building that have not been specifically applied for and authorized by City officials. Only those facilities specifically applied for shall be occupied. Entrance into all other areas shall be prohibited. Applicant must be present during entire time of use. 10. The rentee/permittee shall incur at their own expense all permits and licenses required for the intended use or activity. Forms may be obtained from the Recreation and Community Services offices. 11. All social dances applied for shall be conducted only by a clu~ or on a group membership basis. No "open to the public" dances will be permitted. DJ's and live music, etc. mus~ conclude one hour prior to close of permitted facility use~ 12. Gambling is prohibited. This includes any game of skill, chance or raffle, played with cards or any other device for money or any other representative item of value. 13. Thel use of alcoholic beverages is permitted only by advance approval at the time of requested use and in accordance with Sta:e and Local law. Ail permits/licenses must be obtained as necessary by applicant. No alcohol may be served past one hour prior to close of permitted facility use. 14. Alliequipment must be used only within its original designated area of the building. The moving or removal of equipment is forbidden. Arrangement of tables and chairs wil~ be handled by the Building Attendant as discussed and approved by the Fire and Recreation Departments. 15. Dec~rations, unless otherwise approved, shall be limited to table or free-standing decorations. Ail decorations must be fire retardant. Time for arranging decorations, preparation of food or other special preparations are considered as gro'~p set-up time. 16. No rice, bird seed, confetti, etc. is permitted in the Wes?borough Park Recreation Center or in surrounding parking lot or sidewalk areas. 17. Normal janitorial cleaning fees will be included in your renJtal rate. However, the facility is to be left in an orderly condition, including the clearing off of tables and removal of decorations and tape. The City reserves the right to deduct additional cleaning charges from the cleaning/security deposit as needed to cover cleaning costs in ghe eveng ghe original estimate did nog provide for all clean-up entailed. Charges will also be deducted from deposit for functions exceeding the time limit or use of areas other than applied for. 18. Renting organization is responsible for the cost of any repair or replacement damage caused by negligence, neglect or other circumsgances, or such of its representatives or inviitees, as well as payments of any costs incurred thereof. This includes, but is not limited to, the replacement of any~all dinnerware, tablecloths, tables, chairs and other equipment. 19. Failure to observe, obey and comply with all regulations as staited and with all City, State and Federal laws, regulations or ordinances shall be grounds for cancellation of any event and/or removing the users form the property; and shall bar such individual, group or organization from further use for a period of time as the City officials shall determine. No refund will be administered in these instances I have r~ad and understand these regulations regarding use and hereby agree to comply with them. I understand that failure to observe these regulations or City, State or Federal law will result in cancellation of my event without refund.
