HomeMy WebLinkAboutReso 92-1988RESOLUTION NO. 92-88 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ORDERING THE VACATION OF A PUBLIC UTILITY AND STORM DRAIN EASEMENT LOCATED WITHIN LOT 14 AND A PUBLIC UTILITY EASEMENT LOCATED WITHIN PARCEL A, VIEWMONT TERRACE NO. 5 SUBDIVISION WHEREAS, the City Council on June 8, 1988, adopted Resolution No. 68- 88, entitled "A Resolution of Intention to Vacate Public Utility and Storm Drain Easement located within Lot 14 and a Public Utility Easement located within Parcel A, Viewmont Terrace No. 5 Subdivision", pursuant to the Public Streets, Highways and Service Easements Vacation Law (Streets and Highway Code Section 8300 et seq.); and WHEREAS, the Resolution of Intention was published as required by law, and notices of hearing were posted in the time, manner and form provided by law; and WHEREAS, on Wednesday, July 13, 1988, at 7:30 p.m. at the Municipal Services Building, 33 Arroyo Drive, South San Francisco, California, a public hea-ing was held where any and all persons interested in, or having any objections to, the proposed vacation, could appear before the Council and be heard; and WHEREAS, no objections of any kind or character were made or filed against the proposed vacation. NOW, -HEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco: 1. That the public utility easements and the storm drain easement, which are nore particularly described in Exhibits "lA, lB and 1C" attached hereto and located within Lot 14 and Parcel A, Viewmont Terrace No. 5 SubdivisioF as shown on the map entitled "Plat of Easement No. B-l, Plat of Easement No. B-2 and Plat of Easement No. B-3" which are attached as Exhibits "2A, 2B and 2C" and incorporated herein, are unnecessary for present or prospective use. 2. That the Public Utility and Storm Drain Easement located within Lot 14 and the Public Utility Easement located within Parcel A, Viewmont Terrace No. 5 Subdivision are hereby ordered vacated. 3. That the City Clerk shall cause a certified copy of this Resolution to be recorded in the office of the Recorder of the County of San Mateo. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 13th day of July , 1988, by the following vote: AYES: NOES: ABSTAINED: ABSENT: Councilmembers Mark N.
