HomeMy WebLinkAboutReso 111-1988RESOLUTION NO. 111-88 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPOINTING JESUS ARMAS TO THE POSITION OF CITY MANAGER BE IT RESOLVED by the City Council of the City of South San Francisco that it appoints Jesus Armas to the position of City Manager, effective September 19, 1988, pursuant to a three-year contract, and with the benefit package known as the Executive Management Compensation Program. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the lOth day of August , 1988, by the following vote: AYES: NOES: ABSTAIN: Councilmembers Mark N. Haffey, Gus Nicolopulos, Roberta Cerri Teglia, and Jack Drago None None ABSENT: None CITY MANAGER EMPLOYMENT AGREEMENT THIS AGREEMENT, dated August 10 , 1988, is between the City of South San Francisco ("City") and Jesus'Armas ("Employee'). STATEMENT OF FACTS 1. The City desires to employ the services of Jesus Armas as City Manager of the City of South San Francisco as provided for by Chapter 2.36 of the South San Francisco Municipal Code and as Executive Director of the Redevelopment Agency. 2. The City Council/Redevelopment Agency, as appointing authority, desires to provide certain benefits, establish conditions of employment, and set working conditions of Employee. 3. Employee desires to accept employment as City Manager/Executive Director for South San Francisco. AGREEMENT 1. DUTIES City hereby agrees to employ Employee as City Manager/Executive Director to perform the functions and duties specified in the Municipal Code, Ordinances and Resolutions of the City/Agency, and to perform such other legally permissible and proper duties and functions as the City Council/Redevelopment Agency may from time to time assign. 2. TERM The term of this Agreement shall be for three (3) years, commencing September 19 , 1988. At the end of two (2) years the City Council/Redevelopment Agency shall indicate whether or not it will continue the employment association beyond the third year or whether Employee should seek other employment. Employee may resign at any time from his position with the City, but if he does, he shall give the City at least ninety (90) days advance notice, unless for health reasons such advance notice cannot be given. 3. TERMINATION AND SEVERANCE PAY City retains right to terminate Employee for any reason. If Employee is terminated by the City while still willing and able to perform the duties described above, the City agrees to pay Employee a lump sum cash payment equal to six (6) months aggregate salary. However, if Employee is terminated because of conviction of any illegal act or act involving moral turpitude, then City shall have no obligation to pay the aggregate sum designated. 4. SALARY Effective September 19 , 1988 City agrees to pay Employee for his services a total of Ninety ~housand Dollars ($90,000.00) per annum, payable in installments at the same time as other employees of the City are paid. Of this sum ninety three (93%) percent will be for his services as City Manager and seven (7%) percent will be for his services as Executive Director. In addition, City agrees to an annual review of salary and benefits based upon evaluation of performance, made at the same time as similar consideration is given other employees in the executive management classifications. 5. PUBLIC EMPLOYEES RETIREMENT SYSTEM (PERS) Effective concurrently with the commencement of this Agreement, the City agrees to pay Employee's share of Public Employees Retirement System (PERS) payments. Such contribution shall be paid in proportion to the services rendered as City Manager (93%) and as Executive Director (7%). 6. CAR ALLOWANCE City shall pay Employee a monthly car allowance of Two Hundred Fifty Dollars ($250.00), of which Two Hundred Dollars ($200.00) shall be for services rendered as City Manager and Fifty Dollars ($50.00) shall be for services rendered as Executive Director. Employee shall be responsible for purchase, maintenance, and insurance of any vehicle of choice. 7. HOUSING ASSISTANCE AND RELOCATION City shall assist with Employee's relocation by providing fifty (50%) percent of the amount needed to purchase a single-family residence of Employee's choice within the corporate limits of the City of South San Francisco in exchange for a fifty (50%) percent equity in the property. Within six (6) months of the time Employee ceases to be employed by the City, Employee must sell his interest to the City, if the City wishes to purchase it, or put the property on the open market for sale to a third party, as mutually agreed upon by the City and Employee. City shall pay relocation expenses up to a maximum of Two Thousand Dollars ($2,000.00) 8. VACATION Employee shall be given credit for ten (10) years City service and accrue vacation at four (4) weeks per year. 9. OTHER SUPPLEMENTAL BENEFITS All provisions of the Municipal Code, Ordinances, and Resolutions, relating to fringe benefits for employees in executive management classifications shall be granted to Employee, the benefits to include but not be limited to vacation, sick leave, administrative leave, holiday pay, retirement health insurance, dental insurance, life insurance and long term disability insurance. -2- 10. OTHER TERMS AND CONDITIONS OF EMPLOYMENT The City Council shall fix any other terms and conditions of employment, as it may determine from time to time, relating to the performance of Employee, provided such terms and conditions are not inconsistent with provisions of this Agreement, the Municipal Code or State or Federal law.
