HomeMy WebLinkAboutReso 21-1988 RESOLUTION NO. 21-88 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCOj STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE EXTENSION OF SOCIAL SECURITY COVERAGE TO CITY COUNCIL MEMBERS WHEREAS, the City Council of the City of South San Francisco desires to alter its "deemed" retirement system pursuant to Section 218{d){6) of the Federal Social Security Act (ACT) composed of positions of members, includ- ing members as defined in Section 22015 of the Government Code, of the Public Employees' Retirement System {PERS) desiring coverage, to include services performed by individuals in elective legislative positions as well as those employed by the City and covered by the "deemed" retirement system, as members of a coverage group established by Section 218{d)(4) of the Act, in the Calif- ornia State Social Security Agreement on March 9, 1951, providing for the coverage of public employees under the insurance system established by the Act as amended; and WHEREAS, State and Federal law and regulations require, as a condition of such coverage, that a division be authorized by the Board of Administration, Public Employees' Retirement System; and WHEREAS, it is necessary that the City now designate any services which it previously excluded from and now desires to include in coverage with respect to the coverage group under the insurance system; and WHEREAS, it is necessary for the City to set forth the modification, if any, of the benefits and contributions under the Present Retirement System that may result from coverage under the insurance system with respect to such coverage group; NOWj THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the Board of Administration, Public Employees' Retirement System, be and hereby is requested to authorize the foregoing division; and BE IT FURTHER RESOLVED, that upon receipt of authorization from the Board of Administration a division shall be conducted in accordance with the requirements of Section 218(d) of the Social Security Act, and applicable State and Federal laws and regulations so that each elected legislative official at the time of the division shall be furnished a form to permit that individual to elect whether or not future services should be excluded from or included under the California State Social Security Agreement as hereinbefore provided; with such coverage effective as to services performed on and after January, 1983; and BE IT FURTHER RESOLVED, that the following services with respect to the coverage group of the City shall be excluded from coverage under the agreement: 1. All services excluded from coverage under the agreement by Section 218 of the Social Security Act; and 2. No optional exclusions desired; and that the Amendment to Old Age, Survivors, and Disability Insurance Agreement between the City and the Board approved by Resolution No. 2947 is hereby rescinded; and BE IT FURTHER RESOLVED, that with respect to the coverage group the benefits and contributions of the Present Retirement System shall be modified pursuant to provisions of the Public Employees' Retirement Law; and BE IT FURTHER RESOLVED, that notice of the division shall be given to elected legislative officials not less than ninety days prior to the date of the division; provided, however, that notice shall be given to elected legislative officials who become eligible after the date of such notice up to and including the date -2- of the division on the date on which they attain membership in the system; and that the Coordinator of Personnel Services and Employee Development is hereby designated and appointed to conduct such division on behalf of the City in accordance with law, regulations and this resolution, including the fixing of the date and the giving of proper notice thereof to elected legislative officials and to all such eligi61e elected legislative officials; and BE IT FURTHER RESOLVED, that the Public Agency will pay and reimburse the State at such time and in such amounts as may be determined by the State the approximate cost of any and all work and services relating to such division. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the lOth day of February , 198 8 , by the following vote: AYES: Councilmembers Mark N.
