HomeMy WebLinkAboutReso 38-1988RESOLUTION NO. 38-88 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING AN AMENDMENT TO THE JOINT POWERS AGREEMENT ESTABLISHING THE SAN MATEO COUNTY NARCOTICS TASK FORCE WHEREAS, by Resolution No. 72-85 the City Council of the City of South San Francisco authorized the City to join the San Mateo County Narcotics Task Force; and WHEREAS, it has been determined to be desirable to amend several pro- visions in order to facilitate the on-going work of the Task Force; and WHEREAS, by Resolution No. 50097 the County of San Mateo has authorized the amendment in question and has requested the other agencies involved to approve the amendment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that it hereby approves the "Amendment To Joint Powers Agreement Establishing the San Mateo County Narcotics Task Force" and authorizes the Mayor to execute the Agreement, attached as Exhibit "1". Haffey ~'ATTEST: ~2~,~ ~/~ ~ City Clerk ~~~ EXHIBIT I TO RESOLUTION NO. 38-88 AMENDMENT TO JOINT POWERS AGREEMENT ESTABLISHING THE SAN MATEO COUNTY NARCOTICS TASK FORCE THIS AMENDMENT to the agreement dated March 26, 1985, by and between ~he COUNTY OF S~N MATEO, hereinafter referred to as "County", and the signatories to said agreement, hereinafter referred to as "City" or "Cities"; WITNESSETH: WHEREAS, the parties previously have entered into an agreement dated March 26, 1985, which created the SAN MATEO COUNTY NARCOTICS TASK FORCE; and WHEREAS, during the past 2-1/2 years of operation of the task force, it has become apparent that certain minor changes should be made to the joint powers agreement, and it is the desire of the parties to amend said agreement; NOW, THEREFORE, IT IS HEREBY AGREED: 1. Section 7(f) of the joint powers agreement is hereby amended to read as follows: (f) Cities or County may provide, with the approval of the Board, all or part of their annual financial contribution by providing the full-time services of personnel. The Board shall establish rules for determining the monetary value of each such City or County contribution of personnel. The Board shall authorize any City to receive a refund if the value of personnel contributions exceeds the City's annual financial contribution. When the Board authorizes such a refund, the Board shall determine the amount of the refund and the method of payment. 2. Section 14 of the joint powers agreement is hereby amended to read as follows: 14. Termination and Disposition of Property. This agreement shall be deemed terminated when the number of Cities participating in this agreement is six (6) or less or when the County withdraws. Upon termination, each vehicle and each item of capital equipment shall be returned to the party contributing such vehicle or equipment and all other assets shall be distributed to the parties hereto in proportion to the contribution of the parties during the life of the Narcotics Task Force, including distribution to parties which may have withdrawn at an earlier date. Upon termination, any surplus money on hand shall be returned to the parties hereto in proportion to the contribution of the parties during the life of the Narcotics Task Force, including distribution to parties which may have withdrawn at an earlier date. For purposes of this section, a City's or Countf's contribution shall include but not be limited to contributions of money, physical equipment, personnel, telephones, physical plant, clerical assistance, support staff, and rental costs. Valuation of such nonmonetary services as have been provided to the Narcotics Task Force shall be valued at the cost to the supplying entity at the time of expenditure. 3. Section 15 of the joint powers agreement is hereby amended %o read as follows: 15. Termination. This agreement shall continue until terminated. Upon such termination, the provisions of sections 13 and 14 shall apply. 4. Section 20 of the joint powers agreement is hereby amended ~o read as follows: 20. Insurance. ~%e County shall add the Narcotics Task Force to its existing excess liability insurance coverage and shall maintain such coverage in full force and effect during the life of this agreement. Said excess liability insurance coverage has a $250,000 self-insured retention by the County. County shall provide for the defense of any claims or litigation against the Narcotics Task Force or its permanently assigned personnel within the $250,000 self-insured retention. Permanently assigned personnel are those persons.~ working under the supervision and direction of the Commander. Legal representation for any such claims or litigation will ordinarily be provided by the Office of the County Counsel. Any out-of-pocket expenses or lo~s by way of _ judgment or settlement, arising out of the acts or omissions of the Narcotics Task Force and its permanently assigned personnel within the limits of the County's $250,000 self-insured retention, shall be sha£ed by the parties in accordance with the following formula: 2 Fifty percent (50%) to be paid by the County and fifty percent (50%) to be paid by the Cities in accordance with the formula set forth in section 7(b). Expenses shall not include salaries or office expenses of any County employees, including any attorneys from the Office of the County Counsel.
