CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION URGING THE LEGISLATURE
TO AMEND SENATE BILL 300 RELATING TO
THE STATE GAS TAX FUND
WHEREAS, SB 300, FORAN, approved by the Governor on October 2, 1985,
provided for additional allocations to Cities and Counties for streets and
highways maintenance and reconstruction, and
WHEREAS, SB 300 further provides that in order to receive an
allocation, an agency must spend not less than its 1984-85 (base year)
expenditures for maintenance and reconstruction not including the
allocation, and
WHEREAS, if the State Controller determines that a City or County
expended less than its 1984-85 base year amount, its allocation of gas
taxes, pursuant to Streets and Highways Code Sections 2104 or 2107, shall be
reduced during the next fiscal year by the amount that its expenditures are
less than ~he base year amount, and
WHEREAS, there are 112 Cities, and 8 Counties that did not meet their
base year 1984-85 expenditure requirements, and therefore, are in jeopardy
of loosing 2104 or 2107 gas tax allocations for the 1986-87 fiscal year, and
WHEREAS, the designation of the 1984-85 fiscal year as the base years
is unfair, due to the year-to-year fluctuations of monies spent for street
purposes by local agencies; and in any case, 2104 and 2107 gas taxes which
local agencies have received and depended on for 25 years should not be
curtailed.
NOW, WHEREFORE, BE IT RESOLVED that the City Council of the City of
South San Francisco hereby urges the Legislature to amend SB 300 (Section
2127 of the Streets and Highways Code) to accomplish the following:
(1) Allow the local agency to use an alternate year for the base year
~nstead of the 1984-85 fiscal year.
(2)
Since some Cities have not spent their allocations because it may
become a liability, allow more time for expenditure of the
allocations.
BE IT FURTHER RESOLVED, that because of budgetary constraints, time is
of the essence.
I hereby certify that the foregoing Resolution was regularly introduced
and adopted by the City Council of the City of South San Francisco.at a
regular meeting held on the 8th day of April , 1987, by the
following vote:
