HomeMy WebLinkAboutReso 60-1987RESOLUTION NO. 60-87 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ORDERING THE VACATION OF A 30' x 40' PORTION OF A THIRD LANE WEST OF MAGNOLIA AVENUE WITHIN THE MAGNOLIA PLAZA HOUSING SITE WHEREAS, the City Council on April 22, 1987, adopted Resolution No. 46- 87, entitled "A Resolution of Intention to Vacate a 30' x 40' Portion of Third Lane west of Magnolia Avenue within the proposed Magnolia Plaza Housing Site", pursuant to the Public Streets, Highways and Service Easements Vacation Law (Streets and Highway Code Section 8300 et seq.); and WHEREAS, the Resolution of Intention was published as required by law, and notices of hearing were posted in the time, manner and form provided by law; and WHEREAS, on Wednesday, May 13, 1987, at 7:30 p.m. at the Municipal Services Building, 33 Arroyo Drive, South San Francisco, California, a public hearing was held where any and all persons interested in, or having any objections to, the proposed vacation, could appear before the Council and be heard; and WHEREAS, no objections of any kind or character were made or filed against the proposed vacation. NOW, THEREFORE, BE IT RESOLVED that the City Council finds that 1. That 30' x 40' portion of Third Lane west of Magnolia Avenue within the proposed Magnolia Plaza Housing site, which is more particularly described in Exhibit "A" attached and incorporated, is unnecessary for present or prospective use as a public street. 2. That 30' x 40' portion of Third Lane west of Magnolia Avenue within the proposed Magnolia Plaza Housing site, is hereby ordered vacated. 3. The City Clerk shall cause a certified copy of this Resolution to be recorded in the office of the Recorder of the County of San Mateo. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 13th day of May , 1987, by the following vote: AYES: Councilmembers John "Jack" Draqo, Richard A. Haffey, Gus Nicolopulos, Roberta Cerri Teqlia, and Mark N. Addieqo NOES: None ABSENT: None ×ATTEST: ~iYty ClerkZ~ EXHIBIT "A" TO RESOLUTION NO. 46-87 TO RESOLUTION NO. 60-87 DESCRIPTION Portion of Third Lane Right of Way to be Abandoned South San Francisco San Mateo County, California Ail that portion of that certain 20-foot wide right of way within Block 96 as said Block is shown oM that certain map entitled "Map of South San Francisco, Plat No. 1, County of San Mateo, State of California" filed for record March 1, 1892 in Book 2 of Maps, Page 52, Records of San Mateo County, said portion being more particularly described as follows: BEGINNING at the most westerly corner of Lot 34 of said Block 96, thence along the northerly line of said 20 foot right of way, southeasterly 30 feet to the northerly end of that portion of the 20 foot right of way abandoned by deed recorded December 19, 1932 in Volume 580 of Official Records of San Mateo County, California at page 352; thence southwesterly along last said line 20.00 feet to a point in the northerly line of Lot 7 in said Block 96; thence northwesterly along last said line 30.00 feet to the northerly corner of said Lot 7; thence northeasterly across said 20 foot right of way 20 feet to the POINT OF BEGINNING.
