HomeMy WebLinkAboutReso 193-1986RESOLUTION NO. 193-86 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION FINDING AND DETERMINING THE NEED FOR CHANGES OR MODIFICATIONS TO THE NATIONAL ELECTRICAL CODE, 1984 EDITION WHEREAS, Section 17958 of the Health & Safety Code requires the adoption by the City of South San Francisco of regulations imposing the same requirements of certain uniform industry codes as specified in Health & Safety Code Section 17922; and WHEREAS, Health & Safety Code Section 17958.5 permits a city to make such changes or modifications to the uniform codes as deemed reasonable because of local climatic, geological, or topographical conditions; and WHEREAS, Government Code Section 50022.4 provides that when a code is adopted by reference, penalty clauses are not deemed adopted by reference but may be enacted only if set forth in full in the adopting ordinance; NOW, THEREFORE, BE IT RESOLVED by the City Council that pursuant to the requirements of Health & Safety Code Section 17958.7 and Government Code Section 50022.4, the Council finds and determines there is a need to adopt the following changes or modifications to the National Electrical Code, 1984 Edition, by reason of local conditions: 1. Administrative Changes. Section 204, Violation, is restated and Section 205, Penalties, is added in light of Government Code Section 50022.4 to conform with other Municipal Code provisions of the City of South San Francisco. These changes are administrative rather than tech- nical in nature. 2' Section 334-23. Metal-Clad Cable. Grounding. The amendment is needed to clarify that internal groundin§ conductors must be provided in each metal clad cable because the existing wording simply refers to an "adequate path." 3. Section 336-3. Nonmetallic-Sheathed Cable. Uses Permitted or Not Permitted. Due to local geological and topographical conditions, it is appropriate to limit the use of Type NM and Type NMC cables to certain residential structures and not permit such cables in industrial and commercial buildings. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause a copy of this resolution, together with the ordinance making the changes or modifications to the National Electrical Code, 1984 Edition, to be filed with the State Department of Housing and Community Development. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a reoular meeting held on the lOth day of December , 1986 by the following vote: AYES: Councilmembers John "Jack" Drago, Richard A.
