CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPOINTING THE CITY ATTORNEY AS RISK
MANAGER AND DETAILING SETTLEMENT AUTHORITY PARAMETERS
WHEREAS, the City of South San Francisco is a member of the Association
of Bay Area Governments Pooled Liability Assurance Network (ABAG PLAN), a
non-profit corporation, for the purpose of providing irsurance coverage; and
WHEREAS, pursuant to the provisions of the ABAG PLAN, and the authority
provided in Government Code Sections 910.8, 935.2, 935.4, and 949 the City
Council desires to delegate its authority to allow, reject, reconsider, comp-
romise, or settle claims against the City of South San :rancisco in certain
instances; and
WHEREAS, the Council wishes to detail settlement authority parameters;
NOW, THEREFORE, BE IT RESOLVED by the City Council ~f the City of South San
Francisco that:
1. The City Attorney, or the City Attorney's designee, is hereby appointed
Risk Manager for the City and is authorized to allow, reject, reconsider, compro-
mise or settle claims against the City of South San Francisco, if the sum in-
volved does not exceed $10,000.
2. The Claims Administrator, designated by ABAG PLAN, is authorized to
settle claims against the City as follows:
a. Amounts less than or equal to
$1500.
b. Amounts greater than $1500 but
less than or equal to $5000.
c. Amounts greater than $5000 but
less than or equal to $10,000.
d. Amounts over $10,000.

3. Pursuant to the ABAG PLAN Liability Risk Coverage Agreement, ABAG PLAN
is authorized to settle claims against the City as fo'lows:
Amounts within the City's
deductible.
Amounts between the City's
deductible and $5 million.
ABAG PLAN, upon consultation
with the City Attorney
ABAG Claims Committee with
the .pproval of the City

4. The Director of Finance, or the Director's de lgnee, shall pay any claims
up to the delegated amount upon the written authority ~f the City Attorney.
BE IT FURTHER RESOLVED that this resolution supersedes Resolution No. 64-79.
I hereby certify that the foregoing Resolution was regularly introduced and
adopted by the City Council of the City of South San F~'ancisco at a regular
meeting held on the 28th day of January , 198 the following vote:
