HomeMy WebLinkAboutReso 127-1986 RESOLUTION NO. 127-86 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ACCEPTING AND APPROVING AN AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES, LOCAL 1569, AFL-CIO, UNIT NO. 2 FOR THE PERIOD JULY 9, 1986 THROUGH JUNE 30, 1987 WHEREAS, the City Council of the City of South San Francisco has recognized the AFSCME, Local 1569, AFL-CIO, as the employee organization representing a majority of those employees working in classifications in representation Unit #2; and WHEREAS, the existing Unit #2 will be merged with the new Unit designated as City Unit "A"; and WHEREAS, inclusion in this Unit is not intended to add, subtract, or in any manner modify the terms and conditions of employment except those as specifi- cally set forth in the attached document; and WHEREAS, the representative of the City and the representatives of Local 1569 have personally met and conferred and freely exchanged information, opinions and proposals; and WHEREAS, the representative of the City and the representatives of Local 1569 have reached agreement on those wages, hours and conditions of employment which are to be in effect during the period July 9, 1986 through June 30, 1987 for employees in representation Unit #2; and WHEREAS, the representative of the City and the representatives of Local 1569 have jointly prepared an agreement; and WHEREAS, the City's representative recommends that the agreement be accepted and approved by the City Council; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco hereby accepts and approves the agreement which is attached hereto as Exhibit "1" and incorporated herein by this reference, as if set forth ver- batim, between the City of South San Francisco and the AFSCME Local 1569, AFL-CIO which sets forth those wages, hours and conditions of employment to be in effect during the period July 9, 1986 through June 30, 1987 for employees working in classifications in representation Unit No. 2, and which agreement shall be bind- ing upon the City, upon Local 1569 and upon the employees covered therein. Haffey, and Gus Nicolopulos NOES: ABSENT: None Councilmember Roberta Cerri Teqlia City Clerk -2- EXHIBIT 1 APPROVED BY CITY COUNCIL RESOLUTION NO. 127-86 AGREEMENT BETWEEN AFSCME/UNIT #2, AND THE CITY OF SOUTH SAN FRANCISCO The parties having met and negotiated pursuant to Government Code Section 3500 et seq. do hereby agree to the following changes in-the terms and conditions of employment from the date of this agreement to June 30, 1987: Term: Except for the salary provisions, the terms of the agreement will extend from the date of execution to June 30, 1987. Recognition, Article 2, Section 1: The existing Unit #2, Profess- ional and Paraprofessional, will be merged with the new unit designated as City Unit "A." Inclusion in this unit is not intended to add, subtract, or in any manner modify the terms and conditions of employ- ment, except those as specifically set forth below. Wages, Article 4t Section 1: For all employees who are in the classifications of Communications Dispatcher and Senior Dispatcher on May 1, 1986, the salary schedule will be increased by ten percent (10%) effective June 28, 1985. Five percent (5%) of this ten percent (10%) adjustment will be a pay equity adjustment. Effective June 27, 1986, the same schedule will be increased by an additional five percent (5%). Insurance, Article 4, Section 4: Unit members employed at the time of ratification of this Agreement, who voluntarily reduce their schedule during the term of this Agreement from the current "4/10" Plan to an 8 hour per day/32 hour per week Plan, shall be provided the health and welfare benefits (S"A"-E") as if they were employed on a full time "4/10 Plan" or one hundred percent (100%) cash in lieu thereof based upon the formula set forth below. Unit members employed after the ratification of this agreement and whose regular work schedule is 8 hours per day/32 hours per week, shall be entitled to elect once each year to have the City pay eighty percent (80%) of the cost of the health and welfare benefits, or have the City pay eighty percent (80%) of the cost of such benefits in cash in lieu of such benefits. The City shall utilize a weighted average for determining the cost of such benefits. For example: 80% (the average cost of Kaiser X the number of City participants; Bay Pacific X the number of City Participants; Blue Shield X the number of City participants) = the weighted average for health insurance. Such in lieu of benefits pay shall not be con- strued as part of the regular rate for purposes of overtime payment. For regular full time unit members, the 8 hours per day/40 hours per week insurance benefits will be as described in Article 4, Section 4, of the Unit "A" Memorand%un of Understanding. 1 Long Term Disability, Article 4, Section 4,E: The waiting period for long term disability benefits shall be twenty (20) days. Life Insurance, Article 4, Section 4tB: The life insurance would be increased to 1 1/2 times the annual salary of the employee. Hours/Work Schedule, Article 5: A. Normal Work Week/Work Day: For unit members employed at the time of ratification of this Agreement, and who converted from the "4/10 Plan," the regular (normal) work week and work day shall be either 8 hours per day/32 hours per week, or 8 hours per day/40 hours per week, depending on assignment selection. For unit members employed after the time of ratification of this Agreement, the regular work week and work day shall be 8 hours per day/40 hours per week. This definition shall apply for overtime purposes even though an employee is assigned to a workday/work week which is less than 8 hours/40 hours, as specified. B. Work Schedules/Shift Assignments The City will alter the work schedules from the current "4/10" Plan to a new schedule as soon as administratively practical, taking into consideration the time required to hire a full staff. The new schedule will be discussed with affected employees and the Union prior to implementation. The negotiating parties have informally discussed a sample work schedule which is attached but not incorporated into this Memorandum of Understanding. If any change is made in the general pattern of the schedule, the City will meet and confer over any proposed changes. Every six months, Communications Dispatchers will be allowed to select a shift based upon seniority. Such seniority shall be determined upon the total hours employed as a communica- tions worker in the Department. In order to provide some rotation of desirable shifts which exclude working on week- ends, no unit member will be allowed to select the same shift which excludes working on weekends for more than three (3) consecutive bid periods. Senior Dispatchers will be assigned shifts by the City on the basis of 8 hours per day/40 hours per week. However, the current Senior Dispatcher will be allowed to have a 32 hours work week during the first 6 month's bid period on an experi- mental basis. The City may reassign that senior dispatcher to a 40-hour work week after the first bid period, at the City's discretion, if the Department officials, after discussion with the Union, believe the division requires more supervisory time. If, during the time that the one Senior Dispatcher on a 32 hour week vacates the position of Senior 2 Dispatcher, that position will automatically revert to an 8 hour day/40 hours per week position. Vacation: Article 6, Section 2: ae Vacation Accrual Rates: Each unit member shall accrue vacation hours in accordance with the following accrual rate schedule, prorated on the basis of a full time position being forty (40) hours per week: Length of Service Annual Rate per Bi-Weekly Payperiod Appropriate Annual Equivalent First through fourth years, inclusive Fifth through fourteenth years, inclusive Fifteenth through twenty-fourth years, inclusive 4.62 hours 6.16 hours 7.69 hours 15 days 20 days 25 days Twenty-fifth and succeeding years 9.23 hours 30 days 9. Sick Leave, Article 6, Section 3: a. Sick leave shall be prorated on the basis of 40 hours per week as being regular full-time. b. Verification of Injury or Illness: Usual Verification: An employee requesting paid sick leave approval shall provide such verification of actual injury or illness as is satisfactory to the department head or the department head's designee. Usually, such verification shall be in the form of an employee's personal affidavit of injury or illness. ® Doctor's Verification of Injury or Illness: A doctor's verification of actual injury or illness is verification which has been prepared and signed by a doctor and which describes the nature and extent of the injury or illness and confirms that the employee has recovered sufficiently to assume light duty or is able to perform regular work without restrictions. 10. A new Appendix "C" will be added to the Unit "A" Memorandum of Under standing which will apply to the positions of Communications Dispatcher and Senior Communications Dispatcher. Entire Article The following additional provisions are incorporated into and made a part of the Unit "A" Memorandum of Understanding, which will apply to the Communications Dispatcher and Senior Communica- tions Dispatcher positions: 1) Article 2. Union Rights Section 5. Employee Mail Boxes Each employee mail box in the Police Communications Bureau may be used by the Union for distributing Union informational materials. 2) Article 5. Hours of Work, Work Schedules E. Work Schedules in the Police Communications Bureau 1. Work Schedules: The Communications Bureau Commander shall schedule the work days and work weeks of employees which shall include shift assignments as necessary. 2. Changes to Scheduled Work Days and Work Weeks: The City shall meet and confer with the Union on any proposed changes to the length of the work day or the number of days per week employees are normally scheduled to work. 4 3. Shift Assignments: The Communications Bureau Commander shall assign employees to shifts as necessary to the effective opera- tions of the Bureau. Employees shall be allowed to bid for their preferred shift assignments in December and June of each year for shift assignments to become effective in January and July, respectively. Seniority within classification will be given priority in assigning employees their preferred shifts, provided that the operating needs of the Bureau have been reasonably met. The Bureau Commander may temporarily reassign an employee to another shift when it is necessary to accommodate temporary employee shortages or the lack of experience of junior employees. The shift schedules to become effective in January and July respectively will normally be posted four (4) calendar weeks prior to becoming efective. Fo Meal and Rest Breaks: An employee shall not depart from the work station during scheduled hours of work unless he or she is properly relieved. Meal Breaks: An employee will be granted a meal break away from the work station of thirty (30) minutes duration, provided that sufficient coverage of the work station is available. Employee's time on authorized meal breaks shall be considered as time worked. e Rest Breaks: When workload permits, employees may be allowed to take an informal rest break within the work station. Employee's time on such rest breaks shall be considered as time worked. The Department will provide a rest break when a Unit member has served an additional half shift of overtime, provided that personnel is reasonably available to cover the break period. Section 3. Overtime in the Police Communications Bureau ae Overtime Defined. Overtime work is authorized work in excess of an employee's normal work week. Paid leave hours shall be considered as hours worked. Bo Overtime Compensation Rate: Each employee shall be compensated for overtime worked at the rate of time and one-half (1 1/2) for which the employee otherwise qualifies, pursuant to the pro- visions of Appendix "A" as follows: Training Time: An employee who works time in excess of his or her normal work week as the result of attending training sessions required by the Police Chief or the Chief's designee, shall be compensated at the hourly rate of time and one-half (1 1/2) for time spent in such training sessions which exceeds his or her normal work week. Usual Overtime: An employee who works time in excess of his or her normal work week as the result of a non-training overtime assignment, shall be compensated at the rate of time and one-half (1 1/2) for time so worked. 5 Ce De ® Court Appearance Time: An employee who is required to appear in court in his or her official employment capacity, shall be compensated at the rate of time and one-half (1 1/2) for time spent in such court appearances when the court appearance does not occur during the employee's normally scheduled hours of work as follows: a. Minimum Time for Court Appearance on Scheduled Work Day: An employee who is required to appear in court in his or her official employment capacity at a time which is not during the employee's regularly scheduled hours of work, but which is on a day that the employee is scheduled or has volunteered to work, shall receive a minimum of two (2) hours of overtime compensation for such a court appearance. Minimum Time for Court Appearance on Non-Scheduled Work Day: An employee who is required to appear in court in his or her official employment capacity at a time which is not during the employee's regularly scheduled hours of work nor is on a day that the employee is scheduled or has volunteered to work, shall receive a minimum of three (3) hours of overtime compensation for such a court appearance. Overtime Assignments: The Communications Bureau Commander shall make such schedued and non-scheduled overtime assignments as are necessary to the effective operations of the Communications Bureau. The Bureau Commander will use the following guidelines in making overtime assignments: Employees shall be allowed to bid for overtime assignments with the employees in the highest classifications bidding first. Whenever practical, seniority within classification will be given priority in granting bids. Overtime will be distributed as evenly as possible among the employees involved and an opportunity will be provided for those employees who want overtime assignments to take assignments from employees who do not want overtime assignments. Whenever practical, overtime will be filled by volunteers or by those employees who are already working or scheduled to work an adjoining shift, rather than by assigning employees to work on their day off. Compensatory Time Off in Lieu of Paid Overtime: The Communica- tions Bureau Commander may allow each employee to accumulate up to a maximum of forty (40) hours of compensatory time at any given time, in lieu of the employee receiving pay for overtime worked. Compensatory time shall be earned on the basis of time and one-half and all compensatory time off shall be requested and scheduled in accordnace with the rules and regulations prescribed by the Chief of Police of the Chief's designee. 6 Bo Ce 3. Holiday Compensation in the Police Communications Bureau In lieu of paid time off for holidays, each employee shall receive holiday compensation as follows: Full-Day Holidays: An additional eight (8) hours of compensation at the straight-time hourly rate for which the employee otherwise qualifies, pursuant to the provisions of Appendix "A" for each payperiod during which each of the following holidays occur: January 1 Third Monday in February Last Monday in May July 4 First Monday in September Second Monday in October November 11 Fourth Thursday in November Fourth Friday in November December 25 Half (1/2) Day Holidays: New Year's Day Washington's Birthday Observed Memorial Day Observed Independence Day Labor Day Columbus Day Observed Veterans Day Thanksgiving Day Day following Thanksgiving Christmas Day An additional four (4) hours of compen- sation at the straight-time hourly rate for which the employee otherwise qualifies pursuant to the provisions of Appendix "A" for each payperiod during which each of the following holidays occur: December 24 Christmas Eve Day December 31 New Year's Eve Day Discretionary Holiday: An additional eight (8) hours of compen- sation at the straight-time hourly rate for which the employee otherwise qualifies pursuant to the provisions of Appendix "A" for the payperiod selected by the employee for receipt of his or her discretionary holiday compensation. In the event that an employee does not select a payperiod for receipt of his or her discretionary holiday compensation by December 12 of each calendar year, the employee shall forfeit the receipt of his or her discretionary holiday compensation for that calendar year. 7 An employee must be employed by the City for a period of three full calendar months prior to becoming eligible for discretionary holiday compensation for a calendar year. De Employees not Eligible for Holiday Compensation: A new employee who is not on full-time regular paid status for the entire pay- period during which a holiday occurs shall not be eligible for holiday compensation during that payperiod. Employees on long- term disability leave shall not be eligible for holiday compensa- tion. Section 2 B a. Vacation Scheduling in Police Communications Bureau The Police Chief, or the Chief's designee, shall schedule vaca- tion periods during which employees shall take the vacation time for which they are eligible. Employees shall be allowed to bid for their preferred vacation periods and, provided that the operating needs of the Communications Bureau can be reasonably met, seniority within classification will be used in granting employees' preferred vacation periods. Employees in the highest classification shall bid first for vacation periods. Section 3. I. 1.a. Number of Hours Payable in Police Communications Bureau. An eligible employee shall receive payment for fifty percent (50%) of the unused sick leave hours on record, up to a maximum of nine hundred and sixty (960) of such recorded hours (maximum of 480 payable hours). 4. Signed this day of , 19 , by: For the City For the Union STEP PLAN T 1 5 6 7 8 IN STEP: Each employee shall complete the following time at each step of the step plan applicable to his or her classification prior to advancing to the next step: 6 months 6 months 6 months 6 months 6 months 6 months 6 months 18 months or up through completion of five (5) full years of employ- ment with the City in a classification covered by this Memorandum of Understanding 9 After the completion of five (5) full years of employment through completion of seven and one-half (7 1/2) full years of employment with the City in a classification covered by this Memorandum of Understanding 10 After the completion of seven and one-half (7 1/2) full years of employment through completion of ten (10) full years of employment with the City in a classification covered by this Memorandum of Understanding 11 After the completion of ten (10) full years of employment and thereafter with the City ina classification covered by this Memorandum of Understanding EDUCATION INCENTIVE: An employee who has completed two (2) full years of employment and who has an AA Degree or sixty (60) accredited units in a field related to the employee's position shall be compensated at two and one-half percent (2 1/2%) above the base wage rate for which the employee otherwise qualifies pursuant to the provisions of this Memorandum. The employee's base wage rate, as adjusted for Education Incentive, shall be established as follows: Base Hourly Wage Rate X 1.025 = Base Hourly Wage Rate Adjusted to Include Education Incentive SPECIAL ASSIGNMENT: An employee who is assigned by the Bureau Commander to perform special work on special assignments such as warrants shall be compensated at five percent (5%) above the base wage rate for which the employee otherwise qualifies pursuant to the provisions of this Memorandum. The employee's base rate, as adjusted for Special Assignment compensation shall be established as follows: Base Hourly Wage Rate X 1.05 = Base Hourly Wage Rate Adjusted to Include Special Assignment Compensation In establishing the actual base hourly adjusted wage rate for an employee, fractions of one cent with a value of four (4) or less will be discarded, and fractions of one cent with a value of five (5) or more shall increase the base hourly adjusted wage rate by one cent. 9 Salary Schedule - Police Communications Bureau (Unit 2) APPENDIX A - Page I
