HomeMy WebLinkAboutReso 162-1986 RESOLUTION NO. 162-86 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING EXECUTION OF SUPPLEMENT NO. 7, TO LOCAL AGENCY- STATE AGREEMENT NO. 04-5177 {FEDERAL AID SAFETY IMPROVEMENT PROJECT) WHEREAS, by Resolution No. 11-78 the City of South San Francisco entered into a Local Agency-State Agreement for Federal Aid Projects (Agreement No. 04-5177) with the State of California in order to obtain money for improve- ments to local transportation facilities; and WHEREAS, it is necessary to supplement this agreement in order to do some specific work on East Grand Avenue Railroad Grade Crossing No. E-10.55-C. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the Mayor is authorized to execute Supplement No. 7, to Local Agency-State Agreement No. 04-5177 between the City of South San Francisco and the State of California Department of Transportation, a copy of which is attached and incorporated as Exhibit "A". I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 8th day of October , 19 86 by the following vote: AYES: Councilmembers Mark N. RRP- 0515 ( 2 ) DATE: 8-11-86 This Program Supplement is hereby incorporated into the Local Agency-State Agreement for Federal-Aid which was entered into between the LOCAL AGENCY and the STATE on 2-1-78 and is subject to ell the terms end conditions thereof. This Program Supplement is adopted in accordance with Paragraph 2 of Article II of the aforementioned Master Agreement under authority of Resolution No. ,approved by the LOCAL AGENCY on (See copy attached). The Local Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with the convenants or remarks set forth on the following pages. Program BC Category Fund Source $ F.C.-O.I_A. 16 (11/85) Dist.:2-SM-0-CR RRP-0515(2) SPECIAL COVENANTS OR REMARKS August 11, 1986 Page 2 of 2 Ail maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. In executing this Program Supplemental Agreement the Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Programs. The Local Agency agrees the payment of Federal funds will be limited to the Detail Estimate amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2), or its modification (PR-2A), and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Assistance. Ail required pavement markings and advance warning signs shall conform to the requirements of MUTCD, 1978 and shall be placed in their proper location by the Local Agency at the time of completion of the Railroad's work. The cost of maintenance of the crossing shall be as allocated by the Public Utilities Commission.
