HomeMy WebLinkAboutReso 53-1986RESOLUTION NO. 53-R6 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ORDERING THE VACATION OF A HIGHWAY EASEMENT ADJACENT TO, AND EASTERLY OF, EL CAMINO REAL BETWEEN KAISER HOSPITAL AND MACY'S WAREHOUSE BE IT RESOLVED by the City Council of the City of South San Francisco as follows: 1. The City Council on the 22nd day of January , 1986 adopted Resolution No. 15-86 , entitled "A Resolution of intention to Vacate a Highway Easement adjacent to, and Easterly of, E1 Camino Real between Kaiser Hospital and Macy's Warehouse, which Resolution recited that the proceedings were undertaken pursuant to the Public Streets, Highways and Service Easement Vacation Law (commencing with Section 8300 of the Streets and Highways Code) and which Resolution of Intention was duly published as required by law, and notices of hearing were duly posted in the time, manner and form provided by law, all as appears from the affidavit of publication and the affidavit of posting on file in the office of the City Clerk of said City. 2. -W~dne~da~v , the 26th day of February , 1986 at the hour of 7:30 p.m. in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, Californa, was fixed in said Resolution of Intention as the time and place when and where any and all persons interested in, or having any objections to, said proposed vacation, were to appear before said Council and be heard. 3. No objections of any kind or character have been or were made or filed against vacation. 4. The City Council finds that the highway easement which is described in the Resolution of Intention and which is more particularly described in Exhibit "A" attached hereto which is hereby incorporated by reference as though set forth verbatim herein, is unnecessary for present or prospective public use, except the permanent easement for the benefit of Pacific Bell and their right at any time or from time to time to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cable, wires, poles and other con- venient structures, equipment and fixtures for the operation of telegraphic and telephone lines and other communication facilities, including access and the right to keep the property free from inflammable materials and wood growth, and otherwise protect the same from all hazards, in, upon, over and across that por- tion of that highway easement adjacent to E1 Camino Real North of Kaiser Hospital as shown on Exhibit "B." 5. The highway easement which is described in said Resolution of Intention and more particularly described in Exhibit "A" attached hereto and previously incorporated by reference, is hereby ordered vacated except for the permanent easement for the benefit of Pacific Bell as set forth in Item 4 and as shown on Exhibit "B." 6. The City Clerk shall cause a certified copy of this Resolution and Order, attested under the seal of the City, to be recorded in the office of the Recorder of the County of San Mateo. Haffe¥, Gus Nicolopulos and Roberta Cerri Teqlia None None 3 EXHIBIT #3274AD 10/21/85 LAA: dmk DESCRIPTION Portion'.of'OldHighway Right Of Way (El Camino Real) To Be Abandoned South San Francisco San Mateo County, California All that portion of a certain 66-fOot wide right of way easement for State Highway purposes as described in the deed granted by Miller & Lux Incorporated, a Nevada corporation,to the County of San Mateo, State of California, dated 26 June, 1913 and recorded July 30, 1913 in Book 226 of Deeds at page 470, San Mateo County Records; said portion of said right of way easement for a State Highway lying within the Burl Burl Rancho and being more particularly described as follows: BEGINNING at the most northerly corner of said right of way, said POINT OF BEGINNING also being the most westerly corner of the laads of the Pacific Gas & Electric Company as described in that certain deed conveyed by Philomene Adel. ine Kiely to Pacific Gas & Electric Company, dated March 16, 1954 and re- corded in Book 2553, Official Records of San Mateo County, at page 36 (43207-L); thence from said POINT OF B£GINNING along the northeasterly right of way line of said 66-foot wide right of way the following courses: South 47° 23' 00" East 373.20 feet; thence tangent to the preceding course southeasterly along the arc of a curve to the right having a radius of 783.00 feet and a central angle of 28° 02' 00", an arc distance of 383.10 feet; thence.tangent to the preceding curve South 19° 21' East 209.2) feet, more or less, to the most northerly corner of that certain'parcel of land being Parcel 1 as described in the Grant Deed conveyed by BARBARA CROSS and WILLIAM G. CORRIGAN, as Successor Trustees of the Gertrude Schulz Living Trust to the State of California, dated June 24, 1980 and recorded September 3, 1980 in Reel 7985 at Image 1025, Official Records of San Mateo County; thence leaving said northeasterly right of way line along a line parallel to and northeasterly of the state of California Department of Trans- portation highway survey Line B for the widening and realignment of E1Camino Real, a State Highway, North 36° 06' 30" West 229.)6 feet, more or less, to the southwesterly right of way line of said 66-foot wide right of way; thence along said southwesterly right of way line northwesterly along the arc of a curve to the left from a tangent that bears North 20° lO' Ol" West and having a radius of 717.00 feet and a central angle of 27° 12' 59", an arc distance of 340.59 feet; thence continuing along said southwesterly right of way line North 47° 23' West 70.26 feet, more or less, to a point on the northwesterly prolongation of the of said parallel line North 36° 06' 30" West 308.79 feet, more or less, to the northwesterly line of said 66-foot wide tight'of way; thence along said north- westerly line North 41° 28' 40" East 5.63 feet more or less to the POINT OF BEGINNING.
