CiTY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
RESOLUTION DESIGNATING THE COUNTY OF SAN MATEO
AS THE AGENT OF THE CITY OF SOUTH SAN FRANCISCO
FOR SERVICE OF PROCESS
· '(REVENUE'AND TAXATION'CODE §5149)
WHEREAS, the Revenue and Taxation Code §5149 provides that any City for which
County officers collect taxes may provide for the defense by counsel for the County
of actions brought against the City under Article 2, Chapter 5, Part 9, Division 1
of the Revenue and Taxation Code (commencing at Section 5149) (hereinafter
"Article 2"); and
WHEREAS, upon such designation .it .is the duty of counsel for the County to
defend such actions; and

WHEREAS, the City still retains the right to provide that such actions shall
be defended by its own counsel; and
WHEREAS, officers of the County of San Mateo collect taxes for the City of
South San Francisco; and
WHEREAS, actions brought pursuant to Ar'icle 2 are, .in many cases, uneconomical
to defend individually and are best handled by a common defense provided by the
counsel for the County;
NOW, THEREFORE, BE tT RESOLVED by the C.!ty Council of the City of South San
Francisco that: !
1. The County of San Mateo .is hereby designated as the agent of the
City of South San Francisco for service of process for any and all actions brought
against the City of South San Francisco under Article 2, Chapter 5, Part 9, Divi-
sion 1 of the Revenue and Taxation Code (commencing at Section 5149).
2. The City Clerk Is hereby dire~ted to forward to the Clerk of the

County of San Mateo a certified true copy o~ this Resolution for their record
to be maintained in accordance with Section 5149(b) of the Revenue and Taxation
Code.
3. The City Council retains the -lght to provide, ,in lnd,lv.ldual cases,
that actions brought pursuant to Article 2 ~e defended by its own counsel.
