HomeMy WebLinkAboutReso 91-1986 RESOLUTION NO. 91-86 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT FOR PARAMEDIC TRAINING FIELD INTERNSHIP EXPERIENCE BE IT RESOLVED by the City Council of the iCity of South San Francisco that: 1. Approval of Agreement. The Agreement entitled "Agreement for Paramedic Training Field Internship Experience" between The Office of the Superintendent of Schools of Santa Cruz County and the City of South San Francisco Fire Department is hereby approved, and a copy of said Agreement is attached hereto as Exhibit "1". 2. Execution of Agreement. The City Manager is hereby authorized lto execute said Agreement on behalf of the City, and the City Clerk attest his signature thereto. Haffey, Gus Nicolopulos and Roberta Cerri Teqlia None None EXHIBIT I TO RESOLUTION NO. 91-86 AGREEMENT FOR PARAMEDIC TRAINING FIELD INTERNSHIP EXPERIENCE BEIWEEN THE OFFICE OF THE SUPERINTENDENT OF SCFOOLS OF SANTA CRUZ COUNTY AND )HE CITY OF SOUTH SAN FRANCISCO FIRE DEPARTMENT THIS by and referred to as "Contractor"). AGREEMENT, made and entered into as of the 14th day of May , 198 6, between the OFFICE OF THE SUPERINTENDENT OF SCHOOLS OF SANTA CRUZ COUNTY (hereafter to as "COE"), and CITY OF SOUTH SAN FRANCISCO FIRE DEPARTMENT (hereafter referred W I TNE SSE~H : WHEREAS: A. COE, through their Regional Occupational ProQram (ROP), conducts a Paramedic Training "-~gram which provides pre-hospital care training ~or persons desiring to become paramedics accordance with the provision CAL, Title 22; Ariicle 3; Section 100146; Field Internship and Training for EMT-P. B. COE is desirous that its trainees paffticipating in the program obtain field internship experience. C. Contractor has faciliites for furnishing this field internship experience to the trainees participating in COE's program and is desirous of making its facilities available for this purpose. NOW THEREFORE, the parties agree as follows: 1. Contractor agrees to provide a supervised program of field internship experience to the selected paramedic trainees in accordance witB the terms and conditions stated in this agreement. the parties. The period of time for each trainee's ~ield internship experience at Contractor shall be mutually agreed upon between ¢0[ and Qontractor prior to the beginning of each trainee's field internship experience. Reasonable extensions of the internships may be agreed to by the parties if a particular trainee requires additional experience. 3. lhe number of trainees to participate in the Field Internship experience with Contractor at any given time shall be mutually agreed upon by COE and Contractor prior to the beginning of the field internship experience program, and may be modified from time-to-time by mutual agreement upon the request of either party~ 4. COE shall be responsible for selecting the individual trainees who will be assigned to Contractor and such selection will be made without regard to the race, creed, color, sex, handicap or national origin of the traiOee. Contractor shall have the right, prior to arrival of the trainees, to request from C0[ additional reasonable informat!on concerning any or all of the selected trainees. ' Contractor may request COE to withdraw from Contractor's Field Internship experience training program any trainee who Co~tractor determines is not performing satisfactorily, or who refuses policies, procedures, rules and to follow Contractor's administrative and patient care regulations. Such request must be in writing and must include a statement of the reason or reasons why Contractor desires to have the trainee withdrawn. Paramedic Training Field Internship Agreement Page 3 COE shall notify the trainees that the trainees shall be responsible for: {a) Following the administrative and patien~ care policies, procedures, rules and regulations of Contractor; (b) Acquiring and using the necessary and appropriate uniforms when not provided by Contractor; (c) Arranging for his or her own transportation and personal living accomodations and costs when not provided by Contractor; and each provided by COE. 8. It is expressly agreed and understoodi by COE and Contractor that the trainees under this program are in attendance with ContractoP for educational purposes, and they are not considered to be employees of Contractor for any purpose including, but not limited to, compensation for services, employee welfare and pension benefits, or workers' compensation insurance. Further, it is agreed and understood that the trainees are students enrolled at Contractor who may be employees of ambulance !companies, fire districts and other organizations and governmental agencies and the COE has agreed to train these individuals as paramedics, therefore, the trainees in attendanc~ at Contractor are not considered to be e=~loyees of COE for any purpose including, but no~ limited to, compensation for services, E l oyee welfare and pension benefits, or workers' compensation insurance. ~:Paramedic Training Field Internship Agreement Page 4 10. Contractor agrees that it will be liable for any loss, injury, damage or liability incurred by reason of anything done or omitted to be done by Contractor, its officers, employees or agents in connection with performance oR this agreement. 13. C0£ and Contractor shall each maintain iin full force and effect during the full term of this agreement liability insurance in amounts and written by insurance carriers satisfactory to COE and Contractor respectively. 14. The term of this agreement shall commence on March 1, 1986 and shall continue in etfect through September 1, 1986; provided, however, 'that this agreement may be terminated by either party upon giving thirty (30) days prior written notice to the other party. 15. The Director COE's Paramedic Trqining Program and Contractor's Chief m Administrative Officer may mutually agree upon, and imay formalize by a separate writing, the operational details of the Field Internship traininglprogram, and such separate agreement and writing will be binding part of this agreement. on both COE and Contractor in the same manner as if they had been 16.
