HomeMy WebLinkAboutReso 107-1986RESOLUTION NO! 107-86 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING AppROVAL AND EXECUTION OF SUPPLEMENT NO. 10 TO LOCAL AGENCY-STATE AGREEMENT NO. 04-5177 (FEDERAL AID URBAN SYSTEM PROJECTS) BE IT RESOLVED by the City Cou~ Francisco, that: 1. Approval of Supplement. Approval of Supplement No. Agreement No. 04-5177 between the CJ ~cil of the City of South San 10 to the Local Agency-State ty of South San Francisco and the State of California Department cf Transportation entitled "Program of Local Agency Federal-Aid Urban System Projects in the City of South San Francisco", is hereby approved, and a copy of said Supplement is attached hereto as Exhibit "A". 2. M-D008 (5) DATE: March 19, 1986 This Program Supplement is hereby incorporated linto the Local Agency-State Agreement for Federal-Aid which was entered into betwee~ the LOCAL AGENCY and the STATE on 2-1-78 and i8 subject to all the term~ and conditions thereof. This Program Supplement is adopted in accordance with Para~r_aph 2 of Article II of the aforementioned Master Agreement under authority of Resol uti on No. , approved by the LOCAL AGENCY on (See copy Attached). The Local Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with the convenants or remarks set forth on the following pages. Ail maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 2. In executing this Program Supplemehtal Agreement the Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Programs. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. The Local Agency will reimburse the State for their share of costs for work requested to be performed by the State. The Local Agency agrees the payment of Federal funds will be limited to the Detail Estimate amounts approved by the Federal Highway Administration in nhe Federal-Aid Project Agreement (PR-2), or its modification (PR-2A), and accepts any increases in Local Agency funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Assistance.
