HomeMy WebLinkAboutReso 1-1986RESOLUTION NO. 1-85 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING APPROVAL AND EXECUTION OF AN AGREEMENT BETWEEN THE UNITED STATES COAST GUARD AIR STATION SAN FRANCISCO AND THE SOUTH SAN FRANCISCO FIRE DEPARTMENT FOR EMERGENCY MEDICAL TECHNICIAN TRAINEES BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. Approval of Agreement. The Agreement by and between the U. S. Coast Guard Air Station San Francisco and the South San Francisco Fire Department for the purposes of pro- viding training and experience for the Unitec States Coast Guard Emergency Medical Technician Trainees, entitled "Agreement" is hereby approved, and a copy of said Agreement is attached hereto as Exhibit "1." 2. Execution of Agreement. The City Manager is hereby authorized to execute said Agreement on behalf of the City, and the City Clerk aries: his signature thereto. I hereby certify that the foregoing Reso"ution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 8th day of January , 1986 , by the following vote: AYES: NOES: ABSENT: Councilmembers Mark N. Haffey, Gus Nicolopulos; and Roberta Cerri Teglia None None ATTEST EXHIBIT "1" TO RESOLUTION AGREEMENT THIS AGREEMENT made and entered into this',Sth day of January , 198f~ by and between U. S. Coast Guard Air Station San Francisco, hereinafter referred to as 'U. S.C.G. # , and South San Francisco Fire Department, hereinafter referred to as 'S.S.F.D.': ¥ITNESS~.TH WHEREAS, U.S.0.G. requires special facilities and -programs for the purposes of providingi training and experience for its Emergency Medical Technician Trainees, and WHEREAS, S.S.F.D. has facilities and programs for such training and experience, and as a community and professional service is willing, under conditions hereinafter set forth, to allow the U.S.C.G. to utilize those facilities and programs hereinafter set forth for training and experience purposes. NOW, THEREFORE, it is mutually agreed as follows: -- 1. S.S.F.D. shall: a. Provide certain facilities for instructional service purposes for a period from O1 January 1986 to O1 January 1987. b. Designate a liaison person to coordinate and integrate programs and personnel of U.S.C.G. with programs and personnel of S.S.F.D. c. ' The on-duty Fire Department Senior Paramedic will directly supervise the work of the Coast Guard Emergency Medical Technician (EMT) trainees. The EMT trainees will only perform such procedures as they are certified to perform in the field, and they will perform these procedures only under the direct supervision of the on-duty Fire Department Senior Paramedic. 2. U.S.C.G. shall: a. Provide qualified EMT trainees and shall administer, supervise -- and coordinate the personnel and training needs of said EMT trainees. b. Designate a liaison person to coordinate and integrate programs and personnel, including EMT trainees, with programs and personnel of S.S.F.D. 1 3. Both U.S.C.G. and S.S.F.D. agree ,that no person, patients, clients, staff or students of U.S.C.G. or S.S.F.D. shall on the ground of race, color, religion, ~ational.origin, sex, age or ha~icappin~ condition be excluded from participation in, Be den~ed the benefits of, or be subjected to diecrinL~nation un, er aH program defined within th~s agreement. 4. Neither U.S.C.C. nor S.S.F.D. is liable for an exchange of money or other consideration for the normal componen-~ of this agreement. ~. Neither the U.S.C.~. E~T trainee~ nor its liaison person shall by virtue of this agreement be deemed an employee of S.S.F.D. for a~y purpose whatsoever, nor shall it or they be entitled to an~ of the rights, privileges or benefits of $.S.F.D. 6. The term of this agreement shall commence on O1 January 1986, and shall continue until O1 January 1987 or until terminated by either party in writing effective seven days from the date of written notification. 7. S.S.F.D. assumes no responsibility for illness or i~jury incurred by EMT trainees while working with S.S.F.D., whether on paid duty or not unless such illness or injury is proximately caused by the act or omission of S.S.F.D., its agents, or employees. 8. To the extent permitted by Federal law, including the Federal Tort Claims Act (28 USC S2671 et seq.), U.S.C.G. assumes liability for and agrees to hold the S.S.F.D. harmless for damages resulting from injury, death, damage to persons or property that are proximately caused by the acts or omissions of its EMT students and staff in the performance of this Agreement. However, nothing in this Agreement shall constitute an obligation of funds of the United States in advance of an appropriation therefor. Notices and demands under this paragraph shall be sent to Commander (dl), Twelfth Coast Guard District, Coast Guard Island, Alameda, California 94501-5100. 2 IN WITNESS hereof the parties here,to have set their hand the day and year first above written.
