A RESOLUTION CALLING FOR A SPECIAL ELECTION ON
A REFERENDUM AGAINST A RESOLUTION PASSED BY THE
CITY COUNCIL CONCERNING THE SOUTH SLOPE OF SAN
BRUNO MOUNTAIN, TO BE SUBMITTED'iTO THE VOTERS OF
THE CITY OF SOUTH SAN FRANCISCO
WHEREAS, on September 11, 1985, the City Clerk of the City of South San
Francisco presented to the City Council of said City a referendum petition con-
cerning the South Slope of San Bruno Mountain, entitled "Referendum Against a
Resolution Passed by The City Council," hereinafter referred to as "petition,"
a copy of which is attached hereto as Exhibit "A;" and
WHEREAS, the petition contains a request for a special election; and
WHEREAS, the City Clerk on August 29, 1985 certified that the petition was
filed on August 9, 1985 by James Keegan on behalf of the petitioners; and
WHEREAS, the City Clerk further certified that the petition is sufficient,
having the signatures thereon of more than rein percent (10%) of the registered
voters of the City of South San Francisco; and
WHEREAS, Section 4055 of the Elections Code requires that the City Council
either repeal the Resolution at the regular m~eting at which the petition is
presented or immediately order a special election to be held not less than
eighty-eight (88) nor more than one hundred three (103) days after the date of
order, at which the measure presented in the petition shall be submitted to a
vote of the voters of the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South
San Francisco does hereby call for a special election to be held on Tuesday,
December 10, 1985 for the purpose of presenting the measure submitted in
the petition to a vote by the people of the City of South San Francisco, and
that the date of this order shall be reflected for all purposes as September 11,
1985.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to procure
all supplies and make all arrangements necessary for the proper conduct of said
election and is hereby directed to conduct said election in accordance with State
law, including but not limited to the applicable portions of the Elections Code
and Government Code.

SAN BRUNO MOUNTAIN AREA HABITAT CONSERVATION PLAN TO PERMIT SITE-SPECIFIC GEOTEC~ICAL REPAIRS
"(4) WT{EREAS, on July 10, 1985, this Council conducted a public hearing on a proposed amendment to the San Bruno Moun-
tain Area Habitat Conservation Plan (HCP), the Agreement with respect to the San Bruno Mountain Area Habitat Conserva-
tion Plan (HCP Agreement) and a permit issued pursuant to Section 10(a) of the Endangered Species Act (Section 10(a)
Permit), which amendment would permit site-specific geotechnical repairs on the South Slope of San Bruno Mountain; and
(4) ~[EREAS, this Council has considered the Final Supplemental Environmental Impact Report and EnvironmentalAssess-
m .... (Final EIR/EA Supplement) and the Addendum thereto previously certified by the San Mateo County Board of Super-
v rs, and upon conclusion of said hearing, adopted findings, and adopted a Statement of Overriding Considerations·
a in accordance with the California Environmental Quality Act (CEQA) and National Environmental Policy Act (N'EPA);
and (4) WHEREAS, the Council at said hearing adopted Alternative 2 as identified in the final EIR/EA supplement, as
the project to be implemented pursuant to the amendment; and (~) ~HEREAS, said amendment, entitled 'Amendment to San
Bruno Mountain Area Habitat Conservation Plan to Permit Site-Specific Geotechnical Repairs' reference to which is
hereby made for further particulars, has been presented to this Council for its review and approval; and (4) WHEREASt
this Council has reviewed and accepted the Biology Study, required by Section IXB of the HCP Agreement, prepared with
respect to said Amendment; and (~) WHEREAS, this Council has examined and approved saidAmendment as to form and con-
tent and now desires to enter into same; (9) NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco that: (9) 1. Approval of Agreement. (9) The Agreement entitled 'Amendment to San Bruno Mountain Area
Habitat Conservation Plan To Permit Site-Specific Geotechnical Repairs' is hereby approved, and a copy of said Amend-
ment is. attached hereto as Exhibit '1'. (9) 2. Execution of Agreement. (9) The Mayor is hereby authorized to execute

~) This A~ENDNENT TO THE SAN BRUNO MOUNTAIN AREA HABITAT CONSERVATION PLAN and Agreement with respect to the San
no Mountain Area Habitat Conservation Plan ['Amendment') is entered into as of . . · by and among the following
ties: the UNITED STATES FISH AND WILDLIFE SERVICE ('Service']; the COUNTY OF SAN MATEO; the CITY OF SOUTH SAN

ASSOCIATES, a California corporation; (1) Recitals (1) ~HERFAS, the Parties have entered into an AGREEMENT WITH RES-
PECT TO THE SAN BRUNO MOUNTAIN AREA HABITAT CONSERVATION PlAN [!Agreement') and EASEMENTS FOR ENFORCemeNT ON COUNTY-
Oh~D CONSERVED HABITAT AND STATE-Oh~fD CONSERVED HABITAT ('Conserved Habitat Restrictions')· and the Service has
issued a permit pursuant to Section lO(a) of the Endangered Species Act ['Section lO(al Permit') for the purpose
implementing the SAN BRUNO MOUNTAIN AREA BABITAT CONSERVATION PLAN ('HCP')i and [~) h"dEREP~· a condition has been dis-
covered within those lands designated as Administrative Parcels 2-04 and 2-05 in Volume II of the MCP (hereinafter
referred to as the 'South Slope Area') which poses a threat of the occurrence of the geologic hazard of landslidesI
and It) ~EREAS, the South Slope Area of potential hazard occurs in part within areas that have been designated as
'Preserved Habitat' and 'Conserved Habitat~ bythe Agreementi and (~) h~IEREAS, the South Slope Area must be stabilized
in order to provide for the public safety and to prevent the possibility of damage and injury to existing and future
houses and residences in and below the South Slope Area, including existing residences across Hillside Boulevard~ and
[2) h~REAS, Section IX B of the ItCP Agreement provides that amendments to the HCP, MCP Agreement and Section 10
permit may be made at three year intervals upon consent and/or approval of the owners of the lands involved, the loc~I
agency having regulating land use authority, the County of San Mateo, and the U.S. Fish and Wildlife Service if such
amendment is supported by a biological study demonstrating that the amendment does not conflict with the prl~ pur-
pose of the MCP to provide for the indefinite long-term perpetuation of the Mission Blue, Callippe Silverspot and
other species of concernI and (~) ;OIEREAS, the necessity for and appropriateness of the actions to be undertaken pur-
suant to this Amendment are supported by a geotechnical study which has been prepared by a registered soils engineer:
and such actions were identified in the Supplemental EIR/EA, prepared for the A~endment and certified by the Board of
Supervisors on ~anuary 10, 1985, as the preferred alternative which is necessary to provide for the public safety and
t~_an econonically and technologically practicable alternative; and (f) ~EREAS, the actions undertaken pursuant to
s Amendment have been determined by a biological study to satisfy the primary purpose of the HCP for the inde£i-
e, long-term perpetuation of the Mission Blue, Callippe Stlverspot and other Species of Concern; and It) ~HEREAS,

cribed in paragraph 2 above and to ensure that the work undertaken pursuant to this Amendment are consistent with the
purposes of the HCP~ the person or entity undertaking such activities shall provide for the mitigation measures des-
cr~ed in the revised section o£ Chapter VII of the HCP for the South Slope project $2-04 as contained in Appendix A

Administrative Parcel: South Slope Projecl~ (04)
Location and description: The South Slope Project is located on the southeast
corner of San Bruno M.ountain, and is bordered by Randolph Avenue, Bayshore
Boulevard, County park and Hillside School. It comprises 337 acres of
european annual grassland and contains loW-grade habitat for the Mission Blue'
and CalliPpe Silvers-pot butterflies (See Figures
.~. Ownmrshilm: The Sou~h Slope Projec. t is owned by V~sitac~on Associates and is
under .the planning responsibili~.; of W. W. Dean an~ Associates.
Project: The South Slope project will comprise 702 to 745 dwelling units
an4 a 25 acre commercial-site. The-=omm~z¢ial site is proposed for part of. '
the.area adjacent to Bayshore Boulevard, a~ the ~astern cna of the project
site ~Figure 2-04 F). The project will result i~ permanent disturbance of
135 acres of land and ~em.morary disturbance of 68 acres which will be '
reclaimed {see Figure 2-04 G). The reclamation of temporarily disturbed
areas will initially be the responsibility of the. developer but will.
eventually be turned over to the Plan Op.e~ator along with the undisturbed
area and become part of the Conserved Habitat. See Figures 2-04 H to J,
.Status: This is a planned parcel. Amendments to the }~CP resulted in the
addition of 25 acres Of temporary disturbance and a reduction of 5 acres of
permanent disturbance from that anticipated in the Concept Plan.
Biclogical issues: The site 6f the South Slope Project is grassland
by european annual grasses and contains host plants of the bo~h the ;4ission
Blue and the Callippe Silverspot butterflies. %~hile the main populations
the butterflies are on the upper Slopes, they were found to u~ilize the lower
area to some de~ree. Of the two insects, more i.:ission Blue were found i~% the -
South Slope area during the 1981 field season (See Figures 2-04 D-E).

Impact: Development of the South Slope as specified i~ the Precise Plan
destroy 3.22% of the population of the Mission Blu~ butterf'ly and 0.46% of.
the ~opulation of the Cal!ippe Silverspot butterfly. It will also remove
habitat now used by the butterflies of concern and other grassland species,
and will destroy any range limit o_* endemic plak%ts on the site.
~iP Objectives -- Specific Conservation Needs: The HCP approach to the South
Slope is to prevent sudden loss of habitat all at once by phasing the project
so that reclamation of cut and fill slopes with host plant species can begin
in the first phase before the final phase of development takes place.

Obligations: The landowner/developer has the follo~,ing obligations:
1. No construction or conversion to urban uses shall be permitted in the area~
designated 2-04-02 on Figure 2-04 C. The boundary of area 2-04-02 may be
adjusted by the Landowner by not more than fifty (50) feet from the line
shown on Figure 2-04 C, 'provided, however, that the total area increased as a
result of such adjustment does not exceed ten (10) acres.(~ Outside. area
02 construction and conversion to urban uses may occur subject only to the
~onditions set forth in Paragraph: 2 below.
2. Prior to any construction ~it:-~.n Administrative Parcel 2-04, the 'Landowner
shallprovide for the following:

c. Constr~-ct'_'i'~n. Provisions. In accordance ~¢ith Paragraph 1' ~bove,' the
Landowner shall not disturb any land in area 2-04-02 except as
provided in 2d below. In addition, the Landowner shall not grade
more than one phase per year. Grading phases are shown in Figure
2-04 I.
d. Reclamation Provisions. ~ith respect to any areas which are
graded or disturbed and thereafter dedicated as Conserved Habitat,
the Lando'-'ner shall prepare m Reclamation Plan for approval by the
City (or County, as the case may be} ~n accordance with its normal
standards and 'procedures for grading permits. These provide for
gradin, g, erosion and run-off controls, and revegetation with native
grassland species approved by the Plan Operator. In addlt~on, the
Landowner shall clearly define on the ground (by snow or two strand
wire fencing or other methods) the limits of disturbance anticipated
and shall limit the construction disturbance to said limits as
· provided in fencing and signing provisions of the M0U and Chapter

temporarily disturbed areas and the permanently disturbed areas as

shown in Figure 2-04 G. Ak the time o~ approval of the reclamation
plan(s), those plans shall substitute for the more generalized maps
referenced in this section. ,
e. Pesticide Control. The Landowner shall establish covenants and
restrictions encumbering Development Areas in favor of the County
and/or City' prghibiting the use of aerial or large-scale spraying
· pesticides without the approval of the Plan Op6'rator.'
f. Buffer Areasl The Landowner shall covenant fn favor of the City of
South san Francisco and the County to establish and ms. tfita~r~ a buffor
· area of up to' thirty (30} feet in width to protect urban, uses within
the Development Areas ir-- fire. Native plants, which will
present an invasion three= to 'gra.sslands within the Conserved

g. Insoecticn. The Landowner shall.; in carrying out Reclamation Plans
for Administrative Parcel 2-04, contract for an inspector ac~in~ for

activities through c,ompletion of the reclamation activities and
accepta, nce of the offer of dedication.
3. Fund an off-sit-~ enhancement program (described below) which is
prescribed.co mitiga=e impacts caused by additional habitat disturba~ce from
geotechnical prooiems within the South SlOpe project. The enhancement
program will take place on a thirty acre .area located in the essuern saddle.
It is %,'ithin the San .Bruno M~untain State :and County Park and is part of
Administrative Parcel 1-09~ See Figures 2-04-K and L.
'The off-siue enhancemeat area consists of grassland habitat, rocky
outcroppings~ scau~ered areas of brush (mainly gorse), and eucalyptus trees.
The par~icular sihe was chosen for enhancement because it contains good
habitat for the ~4i~sion Blue and Callippe Silverspot butterflies. However,
the area has r~cen~ly become subject to gorse and eucalyptus invasion.
There are many~ca~tered bunches of gorse; (approximately 10 acres) in and

Work Program Specifications:
Exotic Su-~cies Removal. Generally this task involves hand removal o~
~nvad-ing patches of gorse, follow up herbicide application of stumps, and
thinning of eucalyptus trees as appropriate. The following specific
measures must be followed by the shrub removal contractor.
a) Prior to the start of the exotic species removal process the boundaries
of the site will. be staked by the Habitat Manager.
b) The field supervisor will consult with the llabitat Manager as to the
priority of gorse patches to be removed.

c) Access to each patch will be clearly understood and marred in the

The enhancement planting will take place when the Plan Operator
has been 'assured t-hat the gorse will not require further herbicide treatment
(within five years after the removal has taken place). The plants and seed
needed for the enhancement can be obtained during these five years,

during the exotic species removal process. Every hour spent on supervision
will be billed to the developer.
The developer must also provide for the on-site reclamation of
any 'slide repair disturbance as specified in the HCP for temporarily

Location and description: The County Park is the largest parcel in .the
Southeast Ridge planning area; it comprises the entire zidge pbrtion of the
Southeast Ridge and reaches down into Buckeye Canyon (Figures 2-05
It has a Varied flora, rgnging from grassland on the sout..h slope and
to brush, and woodland on the north side,
· k. OwnerShip: The entire parcel is owned by the .County of San Mat.eo.
Project: The County. has proposea a system of hiking t~'ails in this portion Of
the Park which will be created out of existing fire roads modified fo~ ~as~er
use. Other than these trails, whiu~° include vista~ points, no parr factlit~es
are-p.roposed for this section o~ ti~e park 0Figur.~. 2-05 F). Grading or minor
disturbance activities required for the South $1op~ development will
take place on 1.5 acres of.County Park land. The 'temporarily graded
areas will be reclaimed with native San Bruno Mountai,~ plant species.
Status: This is a planned parcel.
Biological Issues: The Southeast Ridge portion of the County Park contains
much of the prime Mission Blue and Callippe habitat (See Figures 2-05
The south-facing slopes in particular have abundant lupine, violet, and
butterfly nectar plants. The area also houses several range limit and endemio
plant species, and the rare ~lant OrthocarDus floribun6us is expected but was
not foUnd during ~he Biological Study, 1980-81. In addition to the plants,
this area of the park is habitat for the San Bruno Elfi~ Butterfly and the Bay
Checkerspot butterfly, '~hich was thought to be e;:ti~ut on SBI.[, and several
other species Of plants and animals which frequent grassland and brush. On
the north side, Suckeye Canyon supports a woodland habitat which is unique to
San Bruno ~!ountain.
~rmpact: Since the proposed trails are 'to be created out of existing fire
roads, 'there w'.ull not be a loss of habitat concurrent with trai~ construction.
Impacts may be~c-~ua~d if realignment upgrading is required. Also, if this
portion of the park i~ heavily patronized and people do ~ot remain on trails,
further impacts may be caused. Grading or minor disturbance activities for
the South Slope project '~ill disturb 1.5 acres of Z4ission Blue and Calli.~pe
Silverspot' butterfly habitat located within t!:e County Par],'.parce].,
~C~ Objectives -- Specific Conservaticn Needs: '.".he County Park is intended to
be used .as a regional recreation area for the surrounding urban centersr
~nvitin~ people to learn about the unique ecolo.gy of San Bruno Mountain° ~t
will also serve as a wa.y to preserve that ecology, t"'herefore, the HCP
approach to the County Park is to conserve existing habitat by minimizin~ the
effects of human encroachment. This will be achieved through 'minimal
construction and limited access to particularly sensitive areas.
In order to conserve the habitat which exists in the park, careful
consideration will have to be given to trail construction and use. In this
section of the park, the adjustments necessary to make the trails useful to
park patrons, ~.e. turning steep trails into switchback trails, must be
carefully considered before initiated; trails should not destroy large areas

of habitat, or disrupt areas heav,_ly utilized by the butterflies of concern.

describe the unique ecology of the locale and require users to remain on the
trails in order to help preserve that eco!ogy. Sensitive areas should be -.
